he looses his curse mark after he kills itachi because itachi gave him amaterasu and it kills the curse mark away and plus if he still had it curse mark unleashes your full potentiol and turns you into a demon so he cant turn his sharingan off so itd unlocks his amaterasu and he couldnt look at an ally or hed burn them to death..
