  • I'm not a law student, I'm in Commerce (Business), but I'm a little curious about this case. Is this not the equivalent of someone selling a car with a blue book value of $500 for $7500?

    I mean, this guy has been a carpet dealer for 22 years. Would it not be a reasonable assumption that he knows the value of the carpets he buys and sells? If the carpet is worth $500 and a carpet dealer who's been in business for 22 years sells it for 15 times that amount, is that not a fraudulent transaction?

  • Hello Mr. Lawyer -you purchased a $500 carpet. You accepted the carpet, wrote a check and failed to obtain an invoice. Here is my question why was the product not validate prior to purchase? If that was the case, Pawn Shops would be extinct.

  • Have there been any GOOD law practitioners on the show? There's this guy; the sleazy attorney Mr Aragon from the other case; and the law student who failed Judge Judy's questions. Are there any cases in which a law practitioner, student, lawyer, paralegal, etc, have actually been GOOD at the law and demonstrated their knowledge well? I'm just curious.

He is more focused on trying to make himself out to be an "honest, respectable lawyer" in the beginning for his business sales as well as try to present himself as someone powerful or whatever to the judge, when he is apparently so incompetent as a lawyer that he didn't even think to have a WRITTEN contract, or even a receipt, and all he has to say for himself is that he "acted foolishly". :|

You can think the rug dealer is dishonest all you want... but ANY lawyer worth his or her reputation would NEVER hand over $7500 without a receipt or bill of sale; and NEVER would any lawyer write out a check unconditionally if he (or in this case his wife) was uncertain about the authenticity of what they were getting. Mr. Mellon blew it... he ideally should have been compensated, but he did everything wrong from the get-go.

  • I just think it's all about the papers, about the filing of the (correct) papers correctly, that's all. I think if he did the whole filing and administrative thing properly, it would have made a difference for him and he would have gotten at least half of his money. I mean, that rug was NOT this Nichols rug which is very expensive, and the buyer, no matter how he acted or not acted - DAT don't matter bro - he should have gotten at least half the money. I don't think he lied in any way. Anyway..

I know Judy was looking for a more firm evidence that a purchase was made here, but because he failed to produce such evidence, i.e., bill of sale, receipt, check with a memo line - I guess Judy didn't grant him zilch! Wonder what Judge Alex would have done in this situation..

It's a bad deal for the plaintiff, but there's nothing wrong with it. "Getting a bad deal" isn't a legal course of action. And without a written contract, there's no proof of whether or not he promised them a "Nichols rug" and he didn't even say it was a Nichols rug in court. Plaintiff bought a rug, they got a rug. If they spent way too much, that's their fault.

  • @rizo020 It is her job to see who's lying, and she believed the plaintiffs were lying as well. The fact is, they had no contract for a "Nichols rug." He gave them a rug, they gave him $7500. Exchange completed. It's not illegal to sell something for higher than it's worth, if two parties enter into an agreement for an object at a certain price, it's not illegal if one of the parties makes a bad deal. Get a contract with details and conditions, that's how you protect yourself.

  • I have to say this shows JJ at her best: She DEMANDED the answers SHE wanted in the order SHE wanted them, and found the TRUTH of the transaction with no BS.

    Being exceptionally hard on a lawyer goes AGAINST her personal interests--since she's a lawyer and might be expected to side with lawyers--and decisions against interest are especially notable.

    But at the end of the day, I do think a fraud was allowed to stand only because JJ didn't want to be seen as showing favoritism to a lawyer.

  • The reason why he lost the case is because, as a business lawyer, she had expectations that he would have followed standard practices to get EVERYTHING in writing, perform ALL communications in writing, and in some cases get things notarized if necessary. This creates a verifiable set of records that outline the entire history of the transaction. Mr. Azzizi is a liar and thief. But the lawyer here is apparently incompetent, or maybe has after years of being in practice become sloppy and lazy.
