I wouldent buy anything from this dealer without a written contract - he clearly looks like a guy who runs scams. And I wouldent buy anything from that lawyer either - as a client it looks like I would just be buying someone making up excuses and making up long stories.
I'm not a law student, I'm in Commerce (Business), but I'm a little curious about this case. Is this not the equivalent of someone selling a car with a blue book value of $500 for $7500?
I mean, this guy has been a carpet dealer for 22 years. Would it not be a reasonable assumption that he knows the value of the carpets he buys and sells? If the carpet is worth $500 and a carpet dealer who's been in business for 22 years sells it for 15 times that amount, is that not a fraudulent transaction?
It's a disturbing fact that there are boneheaded people out there that call themselves "lawyers" (The plaintiff) that don't even have the basic sense of thinking in a logical way...How in the world did they even pass the law exams?..Something is seriously wrong in the american education system.
The P should have brought the case to someone that listens to the facts even though the P did not have a contract he should have got his money back because the D is a scammer but in JJ world she does her own thing next time bring it to a Judge that listen's more and talks less

Yea, zKrellyn. It's correct. Different judges, different judgments. It's not an exact science, this law. I guess it could lean any way you want. Both judgments would be correct, each with different reasoning.

You can think the rug dealer is dishonest all you want... but ANY lawyer worth his or her reputation would NEVER hand over $7500 without a receipt or bill of sale; and NEVER would any lawyer write out a check unconditionally if he (or in this case his wife) was uncertain about the authenticity of what they were getting. Mr. Mellon blew it... he ideally should have been compensated, but he did everything wrong from the get-go.

Exchange completed. It's not illegal to sell something for higher than it's worth, if two parties enter into an agreement for an object at a certain price, it's not illegal if one of the parties makes a bad deal. Get a contract with details and conditions, that's how you protect yourself.
Probably the lawyer's biggest mistake was his sloppiness in pursuing a refund once he knew it was a fake rug. He took too long and failed to create a paper trail.

ok....common sense here. you do not spend seventy five hundred on a piece of art without having it appraised unless you are buying it from an extremely reputable place such as a gallery. that is simply unintelligent. i would not even spend one thousand without an appraisal. they were cheated out of money, but it could have been easily avoidable.
I have to say this shows JJ at her best: She DEMANDED the answers SHE wanted in the order SHE wanted them, and found the TRUTH of the transaction with no BS.
Being exceptionally hard on a lawyer goes AGAINST her personal interests--since she's a lawyer and might be expected to side with lawyers--and decisions against interest are especially notable.
But at the end of the day, I do think a fraud was allowed to stand only because JJ didn't want to be seen as showing favoritism to a lawyer.
Every case of Judge Judy I ever watched that involves Attorneys/Lawyers, she always ended up wiping the floor with them. What an idiot Plantiff. Did he go to Everest? Also, The Defendant is crooked as hell.
The reason why he lost the case is because, as a business lawyer, she had expectations that he would have followed standard practices to get EVERYTHING in writing, perform ALL communications in writing, and in some cases get things notarized if necessary. This creates a verifiable set of records that outline the entire history of the transaction. Mr. Azzizi is a liar and thief. But the lawyer here is apparently incompetent, or maybe has after years of being in practice become sloppy and lazy.

ok....common sense here. you do not spend seventy five hundred on a piece of art without having it appraised unless you are buying it from an extremely reputable place such as a gallery. that is simply unintelligent. i would not even spend one thousand without an appraisal. they were cheated out of money, but it could have been easily avoidable.

I have to say this shows JJ at her best: She DEMANDED the answers SHE wanted in the order SHE wanted them, and found the TRUTH of the transaction with no BS.
Being exceptionally hard on a lawyer goes AGAINST her personal interests--since she's a lawyer and might be expected to side with lawyers--and decisions against interest are especially notable.
But at the end of the day, I do think a fraud was allowed to stand only because JJ didn't want to be seen as showing favoritism to a lawyer.

The reason why he lost the case is because, as a business lawyer, she had expectations that he would have followed standard practices to get EVERYTHING in writing, perform ALL communications in writing, and in some cases get things notarized if necessary. This creates a verifiable set of records that outline the entire history of the transaction. Mr. Azzizi is a liar and thief. But the lawyer here is apparently incompetent, or maybe has after years of being in practice become sloppy and lazy.
