The cop grabbed his baton not his gun until they had him on the ground and he fired warning shots.

Police keep a round chambered, taking the time to chamber a round could easily get you killed in a deadly force scenario. 3) If you ever fired a semi automatic, you would know you don't cock back to "load the barrel" and then "thumb back" the hammer, the hammer is cocked when the slide is pulled back.

@chrispjon Actually, he intended to tase Grant, not shoot him. He panicked and pulled the wrong weapon. Cops can not be afforded that kind of leeway when charged with public safety, he absolutely deserves jail time for his criminal negligence. But execution? Not even close. He had no intention of shooting, much less killing, Grant.

@chrispjon About 6 hours, actually. Pretty obvious from his distance, angle, demeanor and reaction that he had no intention of firing his pistol. At least 6 other officers have made the exact same mistake, firing a pistol instead of a taser. It happens. That doesn't make it alright, and Mehserle obviously deserves jail time for criminal negligence. But execution? That theory lacks any credibility or even a modicum of common sense.

@jdector53 I'm sick of people making this comparison because there is no comparison to be made. No civilian has any right or duty to draw a weapon on an officer. If it were TRULY an accident (for example had he been in his bedroom cleaning his gun and accidentally killed a cop walking down the street), he would be charged with the same thing, involuntary manslaughter. If he was in commission of another crime or if he drew a weapon on an officer that would be capital murder.
