  • Here's the truth - the H1B Visa system is a complete sham because the visas are being used to fill entry-level Bachelor jobs and as a result internationals are coming and taking our entry level jobs that that American college grads are getting shut out of. I know this because I work in Human Resources.

    And if you are ready for some facts, GET THIS: a guest worker on H1B is free to take up a new job that pays more, but an H1B worker stuck in the EB GC process is expected to deny job promotions, otherwise restart his green card process.

  • Your understanding is completely skewed, and I wonder if Lou Dobbs did this to you, or are you basically not able to appreciate anything but lies and half-truths? My dear American-Born: it's when demand exceeds supply that the world knows it a booming economy... like it is now... even as the housing market is going down. If there is no shortage of skilled workers, it would be a dead economy, like it was in 2001-2002. You really need a wake up call here... please read the next message as well.

  • I believe your issue is with outsourcing and skilled workers coming to the US on an H1B visa. You think they are taking away jobs from you and acting as a dampener on a booming tech jobs market, for they work for cheap salaries. First of all, you are living in the US, and talking socialism. So if anyone should feel out of place here, it is YOU.

    Even then, what do you think will allow an H1B worker to stop working for a low salary? Think about it, and read the next message.

  • Do you know how hard it is for an offshore IT business to retain its H1B workers working here on deputation? If such an H1B worker is unhappy with his salary, he will likely find another permanent job at some point in time. His new employer will file a green card petition for him. Now, do you not see that it is in YOUR interest if he gets his green card sooner, and competes with you on the same ground, rather than be at an unfair advantage by accepting a smaller paycheck?

Don't you see that it will in fact hurt you if more jobs were shipped offshore and more H1B workers kept on coming and then going after being frustrated with the broken green card process, thus making way for new low cost H1B workers to replace them?

  • You want H1B workers to not compete for jobs with the unfair advantage of a smaller paycheck. Well, give them their green cards, or at least remove the ridiculous restrictions on job mobility, promotions, increments, and you have automatically fixed the low cost labor issue! This is already happening in countries like England where a temp worker is eligible for the Permanent Resident status, as soon as he completes 5 years of working there for any employer, any income, and at any level!

  • Could your company perhaps sponsor you for a green card vs. H1B? Especially if you have been with your company for so long? Or even find another job that will? I have friends in the tech industry working in silicon valley that have done that. Hope your situation gets better!

  • My employer has indeed sponsored me for a green card. The process takes too long, and makes unreasonable expectations from the applicants (e.g. you can't even take a promotion, forget taking up a different job!) That is why, we are requesting the Congress to address this issue.

We are not asking for MORE H1B's, we are asking for a fix to the broken high skilled immigration process for people already working here because they are in demand here. Second of all, if high skilled workers are discouraged from immigrating to the USA, more offshoring will happen, whether you or I like it or not.

  • Offshoring was not the brainchild of Indians. It became a successful business model because of the high availability of skilled professionals in other countries, who could work in different time zones. With competition, businesses could expect high quality and shop and choose from a number of offshore software service providers. If you hate it, you have my sympathies, but in a capitalistic economy, it is the business needs that dictate the terms.

Secondly, what American-born citizens can or cannot do is besides the point, the fact is that the contribution of high skilled immigrants is tremendous, as acknowledged by this report.

    If someone is given a pink slip in the booming economy like it currently is, it is not because of high skilled immigrants.

    You are not an immigrant. You're a NON-immigrant.: Correct, and I happen to know that "not an immigrant" means the same thing as "NON-immigrant".

    H-1B visa is a NON-immigrant visa.: Correct. However, it allows for the "intent to immigrate". When will you guys learn to do your homework? If you read the first few comments here, you could see a paragraph pasted from the USCIS website, clearly stating this fact, in ENGLISH.

  • Every legal US resident has the right to association and every such democratic process. Therefore we, the LEGAL immigrants, are petitioning the congress to fix a broken process that is affecting lives of a million high skilled immigrants, that is, prospective US citizens, who, by the way, are bringing a lot of wealth (monetary as well as intellectual) to the US. No wonder we are considered important, and no wonder it disturbs someone like YOU who wants a medal simply for being born here!

In fact, IV recently got a CNN reporter to correct the described intent behind IV's DC Rally from "demand for an increase in H1B cap" to "demand for an increase in Employment Based green cards". Do you get that? WE GOT CNN to correct their report!

  • Congrats, you are actually closer to the issue than your friends! I cannot speak for every H1B. However people will not wait for the green card if they wanted to go back to our countries, a lot of them do because they do not intend to immigrate. Those of us who apply for a green card, want to work and live here for a long time if not forever. Many of us will graduate to US Citizenship, eventually.

  • However, unlike YOU, we high skilled immigrants are confident about finding work here, and perhaps even starting a business and giving others like YOU a job one day! Even if I agree with you in that there is a risk in getting replaced by an H1B one day, we are embracing this risk, because we are making the conscious decision of spending our lives in this country... the country also known as the land of opportunity.

You cannot overrule what a growing economy brings with it-- for example, increase in population, and yet, new jobs that cannot be fulfilled by locals. If you think this only happens in the USA, consider going on a world tour.

  • What are you smoking? There have been hundreds of thousands of jobs losses by Americans, replaced with H-1bs. Azim Premji even admits it.

    Job losses that you are describing do not occur due to H1B's. They happen because a business decided to cut costs and assign a project to some vendor who will either bring his own workers and provide quality work for competitive rates, or will do the same project in his own office placed some place offshore.
