God, Bill is simple. Kelly didn't do a good job simplifying her argument but in short, if a third party passes off information to a news organization the news organization can not be prosecuted. Otherwise, you'd have every single news organization charged all the time for putting information that was classified or what not, and your freedom of the press would be about that of China's.
