  • It's called the Fair Debt Collection Practices Act. This is a good tactic for people who wind up in unforseen circumstances, but unfortunately this method is used mostley by irresponsible dipshits that dont want to pay back money they owe. And... if you demand they cease & decist, by law they have to, but you might end up getting your ass sued, of which you fail to mention. Better to work with collectors if you owe it than to be a professional debtor.

  • ive been a bill collector for years and i hate irresponsible people. theres no excuse for credit card debt whatsoever. its not the collectors fault you went out on a shopping spree then cant pay for it. i can understand medical bills. shit happens and alot of people dont have ins. thats understandable. but people who refuse or cant pay credit card bills are just flat out deadbeats. no excuses. its simple........if you cant afford to pay for it, DONT BUY IT!!!!!!!!!!!!

I used to think about the financial responsibility in a different light untill I saw how responsible the banks and financial institutions are>>> Bailouts anyone???

  • To all those who commented that if you have bill collectors calling you should get off welfare and pay your bills you don't know jack. I lost my job after a work accident it took 5 yrs to get the company to pay my medical bills. While waiting those 5 yrs I had bill collectors calling me demanding money threatening to sue me and I kept telling them it's a work comp mater call my lawyer I finally had to have my lawyer call them to get them off my back. BTW they got paid as promised by work comp.

  • Wanna stop bill collectors? Ask them to send you a copy of the contract (evidence of indebtedness.) There is no contract and without a contract there is no obligation to pay. The courts are all about CONTRACTS! Collection agencies are all a scam.

  • debt collection agencies are sooooo heavily regulated that the ones who break the law will not be in business much longer. Yes, people should go after those bad apples but someone needs to post a video on the good agencies just to be fair. I've spoken to people and treat them with respect and work out solutions to repay a debt and alot actually thank me for calling them.

  • Im a bill collector as well... a cease and desist letter is probably not the best choice because the banks can take legal action at that point if they choose... Most financial institutions have assistance programs which can lower payments/interest rates in today's economy... If you weren't smart with your finances and have run up thousands in debt you do need to take responsibility and pay your bill... It doesn't take much effort to stop the continuous phone calls...

  • @lstguy22 If you are truly a debt collector then you surely know that the alleged borrower create the fund with their signature; the debt is a ledger entry on a computer screen. the bank has loan none of it's assets and risk nothing.( see ) MODERN MONEY MECHANICS ( publication put out by the Chicago Federal Reserve Bank ) the loans are created at the signer's PROMISE TO PAY out of thin air!. Also see video called MONEY AS DEBT. Your statement may be valid for credit unions but not for all banks.

  • @lstguy22 If you are truly a debt collector then you know that banks don't loan out it's asset and that the alleged borrower creates the fund for the loan at their PROMISE TO PAY, the debt is nothing more than an entry on a computer screen. See MODERN MONEY MECHANICS ( a publication by The Chicago FEDERAL RESERVE BANK banks risk nothing! The person's signature mortises the so called loan application! and that's how the " Loan " is legally created. only the bank don't tell you, now that's fraud!!

  • Well, it's the law. It does stop phone calls but they can still sue (if applicable) and could still put on credit report. It only applies to collection agencies not to the original creditor.

  • you have no responsibility to repay a second party tell them you have no business, contract with them. and hang up. the debt has been discharged by that point & these collectors will take anything they can get, they paid pennies on the dollar,& are paid by commision

  • this is a good way to keep your bill bouncing around from call center to call center. this is also a good way to get sued by your creditor once they see you have no intent to pay. if you really want to stop bothersome phone calls from bill collectors, pay your bill. its simple.

After two years of threats and they were getting nowhere fast, they wrote offering me this deal, we will slash your debt in half. My response was what debt I am God. Result no more contact from the bank. :)

  • Got a credit card when I had a job. Lost my job, couldn't pay the bill. I've had this problem, as well. The woman didn't seem to understand what "I lost my job" means. She kept saying I shouldn't have gotten the credit card if I couldn't pay. I tried to tell her I COULD pay when I got the card, but I'm not psychic, and didn't predict losing my job. I ended up screaming at her, that based on her logic, no one should apply for credit, since no one knows for sure what the future holds.

  • No they can't. Some bill collectors have threatened to have people arrested, and one bill collector threatened to have some person's child kidnapped if they did not pay on a bill. It is against the law to say "anything" to a consumer. Some bill collectors have been sued, and some even prosecuted.  No they cannot just tell you anything to anyone.

  • @willi493 No good information exists here up to this point. If you want valid usable information you need to visit Bill Bauer and his web sites. Check Google to find those. Bill is also known as credit wrench and has a web site by that name. It will teach you how to deal with your debt problems both in and out of court. It will teach you how to respond to debt collectors on the phone and in court and make them go away and forget about collecting anything. This movie tells us no such things.

    I could never be a bill collector. I'm very sensitive to people who are in debt. If I were Deborah, I'd tell him to just simply pay when can, and when he can get back on his feet again.

  • The problem is, you can't be sympathetic, empathetic yes, but you have to understand that if problems arise, you have options before you go into debt to work with banks and so forth. Never ever take out more than you can chew and if a problem is about to come up in your life, whether sudden or expected, call the right people. I find it funny how the collectors are seen as evil when it's the consumer's fault 80% of them time

    And it's not that collectors are evil, they just seem deaf half the time. I have no money means to a collector, that there's money for a payment plan. Or, I lost my job means I'll have enough money in two weeks to post-date a check.

    I think you better recalculate your 80% estimate too. Maybe where I'm missing something is that collectors aren't people or they think debtors aren't.

It's common sense and when I was in debt, the bank forgave a payment, pushed one back once, even got me a better deal until I got into my IT career. I have been in between jobs, on starvation salary, and so forth, but I've got friends, relatives, and I don't let things ride like you do

    That aside, I can see the benefit of your advice and I agree for the most part. However, this Darwinian approach to unfortunate circumstances shows that you lack human compassion, and also that you are not grateful for your fortunate circumstances. Not everyone has what you had. Instead of putting yourself on a pedestal, you should be thanking your lucky stars, and if you really believe that you've figured something out you should be helping people.

  • This doesn't pertain to 1st party collectors, mean, if you borrow money from a bank or credit union and it is the same bank or credit union calling you they are called 1st party collectors. Once it goes so far past due on an account it is sent to an outside credit agency and they are considered 3rd party collectors, then it it feasible to send them a letter requesting to cease the calls. :o)
