No, Sofia Starr was a witness, too. The evidence of them committing the crime has already been turned over to the police and the DA. Penguin is just a witness at that point and being convicted of a crime DOES NOT prevent him from testifying in the SEPARATE case. Don't make LEGAL comments when you obviously have NO experience in the matter. Batman and Robin are CRIMINALS. They even knew the risk they were taking and it bit them in the ass.

When I was a kid, I thought Penguin was eating chicken noodle soup. The jar says imported sardines, but it looked more like artichoke.

I always thought sardines came out of the tin. And if you look closely at the bottom right, it says that the sardines are "very special." Had to be if they were packed in glass.

Look, the bottom line is that Penguin was probably in a rush to meet Sophia and needed to grab some quick energy food.

You know what, this episode reminds me of Batman Returns were The Penguin tries/ or becomes part of society. I mean the movie goes as far as to have the Penguin fake a rescue of the mayors baby, when the goon takes the baby into the sewer and the Penguin brings it back.
