its just as marynera sauce said, california and iowa both paseed gay marriage laws then suspended them and califonia is feverishly working on getting it through cal. supreme court, which we are hoping will work this time we have a pretty liberal court in cal. and they should re-instate gay marriage laws to before prop 8 language....in U.S. each state has its own constitution which is subservient to the national ...cal. constitution is longer than constitution of some nations
Currently Prop 8 in CA is under trial in the the state supreme court, where they will decide if it is unconstitutional or not by June 3rd 09. If it isn't they'll repeal Prop 8 and Gay marriage will be legal again in CA. It's actually really similar to what happened in Iowa.
Last year Iowa legalized gay marriage for the first time, then it was challenged and suspended, and now it's legal again. Hopefully CA will follow the same path. :]
Oh I love your accent! Is gay marriage legal in Scotland? I only know about Canada's stance, which is good, I don't know about any other countries. I've been too pissed about California to look anything else up recently.
I'm not an expert on the law, but from what I can tell, Prop. 8 should have violated California's state constitution (and if not, California has a really shitty constitution). The reason why is because it was a simple majority vote to put an amendment into their constitution, and in America (and presumably the UK, but who knows) there's a VERY difficult process that you have to go through in order to amend a constitution. So it wouldn't be surprising to see it overturned pretty soon.
