Was brand new. Video was actually shot BEFORE purchase. It turns out after I researched this more that a lot of them were messed up. I guess it fixes itself after you actually activate the thing properly, instead of using the little switch in front.

Yeah, most of those have been tampered with though. I work for a toy company, trust me, the Elmo's don't normally swear :D
