Right click the file and go to Properties. Under the General tab below "Type of File" you will see "Opens with" that should be set to Itunes. If it is set to anything else, hit the change button and select the proper program.

Yes it is legal, you just void the warranty. So if its gets broken, say you drop it and the glass breaks, they won't replace it.
