Actually, the land was granted to them via an ambiguous document, The British Mandate for Palestine, from a British official after WWI. This because the Rothschilds offered support in the form of funding during WWI in exchange for this.

Both peoples were at the time under the rule of the British. After the land was granted to them it would take 26 years before the state of Israel would be declared.
