  • Great job getting the vid and audio on this case. I do have a question for Sam. What if it was assumed that at the time you accepted a benefit (you wouldn't be there unless they already had alleged signed proof that you did...), that you understood the cause and nature of the conditions of that benefit? You had a driver's license correct? Your signature is on the driver license application? Read with a law dictionary, the words you agreed to.

  • I'm undergoing a similar situation. I live in Bryan TX & I was charged with "failure to wear a seat-belt", but I wrote Non-Assumpsit clearly on the ticket, & since then all the court documents they've handed me I've signed that way as well, but when I went to pre-trial, I basically agreed to a not-guilty plea & set for trial before knowing much of this, so if you have any good advice for me, itd be much appreciated

  • this is happening to me in kansas right now... .and they tried to declare me incompetent, I gave the counselor a history on law, and the constitution. He said that Just because I believe in upholding constitutional rights, does not make me crazy.... so Now I can represent myself. And there will be hell to pay for those bastards.

  • Are you a lawyer? If not then why are you following all their rules and jumping through all their hoops? You know what I file? A letter sent USPS certificate of mailing. Is the letter double spaced? Nope! If they complain what do I say "If you have a copy of my license to practice law, then I would be very happy for you to produce it. If you cannot produce said license, then too bad! I am in control in these situations. You are not in control. That is why you lose and I win!

  • You're bringing up correct issues in the WRONG 'court' - you're being brought in to an administrative commercial hearing and trying to argue 'the law' - all that applies in an administrative hearing is up to the administrator. Take a look at the def. for a 'court of record' in Black's 4th and start learning how you can easily obtain a remedy when you are being falsely charged with violating codes to which you are not subject (but certain courts act like they're a real court and people buy it)

  • Sam, this was very instructive - thank you for posting it. Here's what I Believe happened in there. As soon as you identified yourself with THE NAME, that is, responded to the judge in the affirmative when your name was called, you created a nexus. A contract. At that point, it does not matter what you say afterwards. You've placed yourself under the courts jurisdiction. You, at that point, "understand." That is, you stand under their jurisdiction. No matter what's said next, you are guilty.

    You say you don't understand, but you hold a driver's license (contract, and to enter it you agree to 'understand' (STAND UNDER) the highway safety code)

    If you 'understand' the invisible contracts, then you will see why they behaved in the fashion they did.

    When the officer wrote up that offer for you, if you hold a license you accept it by default, whether or not you physically take it, sign it, rip it up, spit on it, run it over.

  • 1st sign the ticket 'under duress' that makes it impossible to get a 'failure to appear' unless the judge 'orders you to appear'. The plea gives the court 'jurisdiction' over you. Conditional acceptance is the only way to stay in 'honor'. "I conditionally accept your charge on proof of claim that you can prove jurisdiction over me". File a claim of right ala Rob Menard or Tim Turners Freedom Docs.

    If there is no 'injured party" you are under 'color of law' and not LAW.

    You didn't mention a verified claim,black robed administrators,!A Corporation operating under commercial law (offer ,consideration ,acceptance) The "COURTS" must show a contract that is violated to get you into their jurisdiction. This is not a court of law but of Equity ,once they get venue before you allow them to adjudicate it is an Admiralty court .Birth cert is not me ,The judge has the right over your legal fiction which you did not deny???

A lot of the things shown here are expressed in Marc's book "Adventures in Legal Land", were Marc goes into a lot more detail, explains the reasons why Judges get upset and stamp their feet like spoilt children when you ask them questions.

  • So it's a complicated system to which you don't understand, and you want professionals that do that job, and trained in it to train YOU to defend yourself, at your leisure, outside of the policy of the court. He seems mentally disabled. Is he alright?

  • Bellamy (1855-1931) adopted the roman salute - a gesture in which the arm is held out forward straight, with palm down - to accompany the American Pledge of Allegiance. Bellamy was not a Nazi. As an admirer of the French Revolution - which meant so much to Jefferson and his friends, 'Liberty, equality, fraternity' - he chose their adoption of the roman salute. For obvious reasons Congress officially adopted the Flag Code with the hand-over-the-heart gesture in 1942.

In December, 2004, I had a similar situation with Judge Jim Boyd and court staff in Prairie Grove District Court in Arkansas, except I didn't bring a camera and the judge did patently threaten me with jail just for asking questions and refusing to sign a Waiver Of Right To Counsel.

  • "Bureaucrats are basically good people" ... I disagree. What's good about stupidity? Nothing. They are theives, whether it's due to stupidity or malevolence is of no consequence. If they simply didn't understand but also hadn't taken action, it would be forgivable. But that's not the case. They don't understand what they are doing, but they have chosen to initiate force against us all. That is unacceptable.

  • Did you just miss the point, while at the same time making it? I beleive he refers to the their intention, not what they are. You are correct in "they don't understand what they are doing" (I hope). The positive thing that Sam has perfect clarity on is that; When good people who beleive they are doing right, find they are mistaken, they change. Sam, I beleive is working towards that definition of change.

  • Rather than say "all men are created equally" I would just state: "all men are equal under the law". This eliminates idiotic religious memes and ambiguity of meaning. Such things confuse the sheep, and we're trying to get the sheep to run interference for us, at minimum, if not stampede in our chosen direction. It's hard to get them on our side if they're confused about the best possible meaning of the terms. (Did god try just as hard to create me as he did my neighbor? Duhhrr...)

  • Yep, fiction... when i worked for the gov, I was fired after refusing to assist in the embezzlement of a LOT of money... mandatory admin meetings at a school district featured smart alecks bragging about ideas to force public schools to watch pornography... my last job, next to the justice dept in the gov complex, turned out to be a front for cocaine distribution... this is just the surface... medical fraud is the biggest one...

  • They are calling it criminal, and have told me over and over to go pay for one of their lawyers, who will only present options the court wants.

    It's such a hopelessly flawed system. Private competing arbitration services will go a long way to end this kind of corruption, malfeasance and outright contempt for customers.

  • I think you can really get to the next level as soveriegn individual under the rule of law, by bringing the charges to their door step. they slapped with a charge based on their leagl fictions, now it's your turn bind them to the constitution using the thier oath of office, and rack up real violations on them, get them fighting with each other and force them to recognize the real law they are supposed to be obeying.

From there on out, I'd just play it cool, as even in a jury trial of your peers should be able to discern what's going on. Have any seen adventures in legal land? He kind of does the same thing at pretrial.

    He wanted me right in the center so the lighting, symbol, etc. all worked in his favor. I suggested we sit at the table as equals, and he backed down.

    I remained on the left side of the bench, so I didn't actually stand where he wanted.

    Later at his do-over pretrial, I sat down in the chair. He had the bailiff escort me to the bench. :) Nice people.

  • Iain1962 your reply tells me you are a cop. Or you do not know the law or your rights. The court you are being tried in is an admiralty court, which they have no right to try you in. If they do not have a signed statement from an injured party then you haven't broken any COMMON LAW, which is what we are to be judged upon. Far from a waste of time. I fought for 5 months and ny case was dismissed.

    I see the point but this is attacking the symptom not the disease. If you really want things to change you have to attack the system not the pawns just doing their jobs, they aren't going to say, "OK you're right let's just forget the whole thing."

    I would have limited my objections to the judge. Perhaps challenged his very authority, but messing around with the pawns in the system doesn't get you anywhere, they are just following instructions.

    Instead of "fighting" them you want them on your side, try and convert those guys in a nice way.

    That's my opinion anyway.

    Probably for the worse. The judicial branch is the only branch left still defending the US public. When people tie up the system like this, the judicial branch might decide to take even more short cuts. My suggestion is, since you already caught the judge as fraud, you should have entered a not guilty plea, trial by jury, and then show the footage in court, or transcribe it. I enjoyed the video, tho. Very brave.

    Newsflash: you are charged with speeding, you have the right to a trial by a finder of fact, the penalty is fines and points.

    Habeous corpus is being exercised, you are being called before a court and can have a trial.

    He is entering a plea because you aren't. Nature of your proceeding = speeding ticket

    Cause = state believed you were speeding.

  • I want to understand the proceedings, the role these people assume in the actions they are bringing against me, and how they attained the authority to initiate force against me.

  • There are hundreds of "non governmental" courts. It's called arbitration / ejudication. If you have a workers comp claim, Unemployment insurance claim, and several others that I can't think of. You agree to them BEFORE hand and sign a waiver stating such.

  • These are actions of ASSUMPSIT debt in a court of no record (inferior court).80% there isn't even a sworn statement to even start a case. They CON people and scare ppl.. They have 1000's of ways to get your consent through your silence.

    B4 there is ever a plea you can.

    1.Abate the action ,

    2.Demurrer,

    3.Demand a court of record (your are the sovereign) which follows the common law (no legal fictions or statutes)

    4. Set-off (statutes are a debt to "society")

  • The judge is not allowed to enter a plea on the behalf of the defendant, because he does not represent the defendant.

    The defendant wanted to understand the nature and consequences of the charges against him. The judge was unwilling to oblige him with an explanation.

    mirkinboy, I think you don't get it. The plea entered FOR the defendant, without the defendant receiving the aforementioned explanation, IS largely the point of this video, questioning the courts authority.

  • Do you really understand? They only wanted the plea. The plea automatically puts you into an action of assumpsit debt. you are admitting to being the defendant and abdicating your sovereignty. There are other choices. You can abate the process or demurrer. The judge is a con artist. NEVER PLEA!

  • Well thodal2000, it seems like the men and women acting as government, don't care about my consent, as their documents require. If that's true, then they believe I'm their subject, and they own me. One guy named judge said he has perosnal juridiction over me.

    Hopefully I have this all wrong? :)

  • I make a "special appearance" to rebut the presumption of "general appearance" and avoid falling into their jurisdiction by being there. At most, I get raised eyebrows, but they know what I mean.

  • hessmjj, either you're corrupt or you're too ignorant of the subject to have an opinion. Until you educate yourself you'll continue to be an accomplice to the liars, murderers and thieves that you call the "government".

    Don't even respond with the "they don't threaten to murder" argument. If you insist on not cooperating, they will murder you.

    clog the court systems, argue every triviality, record everything, and, if you are on a jury for a non-violent case, be sure to use jury nullification. anything you can do to end the functionality of the court system.

  • Judges can consider your motion disposed without taking any action.. Common procedural law. I appreciate your veracity though.

  • Granted I am not a lawyer.. I have vigoursly fought speeding tickets including serving motions to compel discovery. In PA procedural law the motion is considered disposed as soon as the judge is served. That is to say the motion is considered disposed without any further action by the Judge. It may suck but those are the rules. A higher court may find that the judge made an error in disposing your motion. In PA there is no prosecutor for speeding ticket trials.....

  • So the Judges routinely call and examine witnesses (e.g. they act as the prosecutor) Also many courts in PA dont have a 'record' there is no transcript for the trial and nothing can be entered in to the record. Hmm sounds simliar to Chineese law if you ask me.

  • Heres how to fight it . Say or do nothing until trial day. show up in court. there will be no prosecutor. (most likely). when the judge attempts to call the office to say ANYTHING at all OBJECT: 'Your honor calling and examing witnesses is the job of the prosecutor, are you now acting as the prosecutor?'

    The judge may say: 'Officer Smith is the prosector'

    OBJECT 'Your honor officer jones is not certified nor licensed to be a prosecutor in the commonwealth.

  • The jusge may say 'Fine trail is rescheduled for next tuesday'

    OBJECT: Your honor, the people new well in advance that court was schedule for today. If they have come unprepared to court the consiquennses of this lies with the people not the defendant.

    Keep objecting (be polite and ask permission since your not a lawyer). If you dont object you automatically consent!

    Now go get em!!!!!!!!!

  • CA. allows the judge to "find facts", so no P.A. is necessary. I had a judge tell me that the State presumes my guilt and it was my priveledge to try to prove my innocence.

    Another entered a plea over my objection and told me "You have remedies if you wish to persue them." Nice way of saying, F.U. I'm in charge.

  • Ha you thought municpal courts are rule of law. Dream on sucker. The Judges are mostly bad lawers turned Alchoholics.
