  • Could you please advice me on what to consider when the w/c insurance carrier wants to know if you're interested in settling your case? What do they determine when they or you come up with an amount? Is it better for you to come up with the first dollar figure or wait for them to do it? I really don't want to settle, but there comes a time when you just can't do your job any longer without pain 24/7 :(

  • Hi Mr. Kostas, I tore the meniscus in my knee in August. I had surgery in September. I'm still having pain, swelling, and fluid on my knee.

    The doctor said there is nothing else they can do because they had to remove the cartilage that I need to just get used to the pain. He said I need to just settle with the work comp. insurance.

    Do I need to get an attorney? I've no clue what to do at this point..

    I had an accident during work, and was treated and released back to work with minor restrictions that didn't prevent me from doing my normal job duties. But was later fired due to supposedly no jobs available for my restrictions. My employer verbally states concerns of my health and fear of future injuries and that I already cost them too much money, before being notified of termination.

    What do you advice in such a situation?

  • I've had an injury about 15 months ago during work. Am I still able to file a claim, or is it too late now?

  • @No1kravitzFan I think most states allow you to file anytime within 2 years from the start of the injury. After that you can't file a claim anymore.

    You might still wait for Mr. Kostas to answer you, I'm sure he would be more knowledgeable on the subject than me

  • @tanalvin1982 I think you may be able to make a claim for worker's compensation and a claim against the person that injured you; as the law does allow for more than a single recovery.
