Since Blagojevich has not yet been impeached, or proven guilty of a crime, his appointment of Burris is still viewed as Legal, based on the US Constitution.. It must be honored as such..

Simply accusing someone of wrongdoing, is not enough to strip them of their Power to act on behalf of the best interest of the State in which they represent.  They must first be convicted and proven guilty before power is stripped. Not stripped based upon an accusation.

Tactically, this is an interesting move by Blagojevich. In America, there is an ideal; "innocent until proven guilty".

By making this appointment, Blagojevich forces politicians to chose between staying true to the American ideal of "innocent until proven guilty", or ignoring that notion and ignoring Blagojevich's rights.

I suspect in reality, politicians and government don't respect the ideal.
