motorized bicycles must be, by law, licensed. if the motor bike (moped) is 50cc or under and the power is less than 2h.p. then it can be operated with a regular drivers license. if it's over 50cc and/or more powerful than 2 h.p. then a motorcycle endorsement is required.

You cannot just bolt an engine to a bicycle and use it on the road. You could build your own vehicle, but with very rare exceptions [telling lies to the inspector] it would have to be built to the very same standard as a "proper" car or bike so it would be VERY expensive.

49.4cc is under 50cc, and under it even if you average, .4 and you average to 0, .5 and above and you average to +1.
So there is no question but that this is legal.
