Palestine was just a name of the region in the Ottoman Empire, but it was never a state or country nor a government that existed. Arab scholars admitted Palestine never existed either.

The Brits gave full rights to the land to the Jews in the league of nations mandate allowing Israel to declare independence and form its nation. Jews bought majority of the land from the Arabs legally even before the formation of Israel in 1948. Arab governments asked the refugees to leave the Ottoman Empire due to the fear of war. 800,000 Jews from Arab nations were expelled and had nowhere to go so they went to Israel.
