Who gets to decide what jobs are productive and what jobs are not?

If i want to hire a man, who would guard my house dressed in Belarusian folk cloth and he would agree on the price, that is below the minimum wage, how would it be unproductive? I am willing to give a portion of what a earn for a service i consider productive.
