  • What the hell is up with this republican war on women? Punishing them for miscarriages? It must really be her fault. She must be guilty for something that is totally natural. Do they think that women miscarry on purpose? They're adding insult to injury by passing these stupid ass laws.

    As a woman (and mother) who lives in Mississippi, this is terrifying to me.

  • It's not at all fair to punish women this way without viewing their backgrounds. What if they decided to keep the baby, but he/she died and it wasn't even her fault? It's true that we should take care of our babies, but most times it is not the women's fault. There's usually a pair to make a baby and it's a complete outrage for a woman to take the heat for something she shared a responsibility with.

  • America has more of its own people locked up than any other country and the government wants even more of us behind bars for BS crimes. Why? Because America's prison system operates like a business. Prisons get $50,000 per year per inmate and get to use their inmates as slave labor at the same time. Do your research people. The smoke provokes a severe asthma attack and during the treatment of that she miscarries and loses the baby. Should we lock up Grandpa for unborn child endangerment or should we lock up the daughter for putting the life of her unborn child at risk since she knew her Dad was a smoker? What is barbaric is trying to control women's lives from birth to death. Where do you draw the line?

  • In that scenario I would say that the causal link between the woman's behavior and the miscarriage is broken by the intervening action of the grandfather. Again these laws are specifically designed to punish mothers who intentionally take drugs while they are pregnant or who engage in activity that is so extremely reckless that they had to have known it would lead to miscarriage. The line is where the woman's action would have lasting effects on the unborn. In favor of crackbabies?

It's fine to disagree with a specific policy or case but to then stretch it and say that we have a police state or dictatorship or say things like "What's happening to this country" is fucking ridiculous.   • The article in the guardian is incomplete - what evidence was presented to support the allegations? An autopsy would determine the cause of the miscarriage or stillbirth. People who abuse alcohol or drugs are responsible for the harm that they do - if a drunk driver killed someone, including an unborn child, they'd be criminal responsible. It wouldn't be "depraved-heart murder" but it would be a crime.

    The majority of miscarriages have nothing to do with substance or bodily abuse.

    The woman in question did not do cocaine while pregnant. There is no evidence that it was even relevant to the miscarriage.

    Furthermore, those who take cocaine are usually addicted to it. Women who become pregnant are not always pregnant by their choice--they may not even have consented to the sex. Several may not know that they even are pregnant.

    This law disregards that. It is wrong.

And in that example, the driver did not know they would harm the child before they started driving. Why would society want to hold a mother who is knowingly harming her unborn child to a different standard? The thought of someone destroying an unborn child's brain through drug use is horrible.

Gibbs is not scheduled for trial until 12/01/2011. The blogs and posts about the "facts" of this case are premature at this point. My post, and the facts of this case, center on whether or not a mother that takes illegal drugs harming her baby should be held accountable.

How is it just to jail women up because of something that can easlly happen, regardless of any circumstance, that they cannot prevent from happening. 1 out of 4 pregnancies end up as a miscarriage. So, by that sense, should we start locking up 25% of the female population because of it? I personally dont think so.

  • My mom had a miscarriage once and it was one of the worst days of her life. She fully intended to have the baby, and was really excited about it. She's a very healthy person and doesn't drink or smoke, and takes extra good care of herself while pregnant. She was depressed for nearly a month after the miscarriage, and the thought of her possibly having to go to prison on top of what had already happened to her is horrendous!

In many women, certain forms of exercise can be dangerous.. too much caffeine.. not drinking enough fluids, taking certain prescriptions, eating too much salt or sugar can all harm the baby atleast in some cases..
