The "No refusal weekend" requires the officer to obtain a warrant if a DWI arrest is made and the individual refuses a breathalyzer test. If probable cause does not exist then the arrest probably would not have been made and the judge will not sign the warrant. The easy solution is don't drink and drive and don't tolerate other doing it.
Ok, here's the deal. What this is if the police suspect you of DWI they can get a warrant, based on probable cause and take your blood in order to test it's alcohol percentage. The blood is taken by a registered nurse, not the police officer.The warrant is first reviewed and signed by a judge, who determines if the officer has probable cause to take the blood. An officer can do this any day of the week, not just on "No refusal weekends."
Here in Wyoming they just passed a law stating anyone suspected of driving under the influence must submit to a breath blood or urine test. Yeah my rights went out the window and ill blow in your little breath machine but if a cop tries to stick me with a needle there is going to be problems.

I had a blood test in late June. My mom has told me though that they need another blood test because they couldn't come to a conclusion about what was wrong from the first one. In Waterloo, Ontario they recently passed a law where if they SUSPECT you are driving drunk they can take you down to the station and take your blood, spit, urine, fecal matter, hair, nail and store your DNA on file even of you turned out to have a blood alcohol level of zero. Actually if you refuse the test and a warrant is issued for your blood, the blood is drawn and sent off. If it comes back over the limit a warrant is issued for your arrest.
That is unless it is 100% obvious that you're under the influence, then if you refuse, you do go straight to jail.

Actually, it is not a scam to collect DNA. The only thing that the police is interested in is how much alcohol is in the blood when it's extracted. Besides, a judge has to see enough evidence that the person is intoxicated before he will "give" the verbal warrant to extract blood.
If the judge doesn't give the verbal warrant, no blood is taken. Just don't drink and drive and you won't have to worry.

Which is why it never happened. An individual was stopped for suspicion of DUI, refused the breath test so a judge issued a warrant for the blood. The individual was taken to the hospital where a "doctor" took his blood via a judges order.

39 were served with a warrant because they exercised their right to "refuse". However, the judge found suficient evidence existed for a warrant to be issued to take the blood.

If probable cause does not exist then the arrest probably would not have been made and the judge will not sign the warrant. If you think obtaining a warrant is based on probable cause is a violation of your 4th Amendment right, then go back and read it. The easy solution is don't drink and drive and don't tolerate other doing it.

Ok, here's the deal. What this is if the police suspect you of DWI they can get a warrant, based on probable cause and take your blood in order to test it's alcohol percentage. The blood is taken by a registered nurse, not the police officer.The warrant is first reviewed and signed by a judge, who determines if the officer has probable cause to take the blood. An officer can do this any day of the week, not just on "No refusal weekends."

I had a blood test in late June. My mom has told me though that they need another blood test because they couldn't come to a conclusion about what was wrong from the first one. Why would they need another one? I believe it was Einstein who said if you expect different results from doing the same thing then you are insane. Seriously how much blood do they need? no, no - if the police stops you and they have any suspicion that the driver took any alcohol or drugs, they demand a test. when the driver refuses he'll be forced to a bloodtest.

Actually, when the driver refuses the test, the police goes to the judge, and the judge issues a warrant for the blood.
If there isn't suficient evidence, then there isn't a warrant for the blood.

Actually if you refuse the test and a warrant is issued for your blood, the blood is drawn and sent off. If it comes back over the limit a warrant is issued for your arrest.
That is unless it is 100% obvious that you're under the influence, then if you refuse, you do go straight to jail.

Actually, it is not a scam to collect DNA. The only thing that the police is interested in is how much alcohol is in the blood when it's extracted. Besides, a judge has to see enough evidence that the person is intoxicated before he will "give" the verbal warrant to extract blood.
If the judge doesn't give the verbal warrant, no blood is taken. Just don't drink and drive and you won't have to worry.

Sorry but it will never happen. It will never be a part of a police officers training because we aren't doctors and will NEVER be authorized to draw blood. So you can go ahead and live in a fantasy fear, but the only ones you have to worry about are the doctors...
But if you don't drink and drive, you won't even have to worry about that.

Actually, we ALL have the right to bear arms. Sorry, but I do believe in the NRA and back them 100%.
Secondly, I have never hurt an innocent person, nor a criminal for that matter. if he jumps out of his vehicle waving a finger and being irate, it will depend on the situation if i do the arrest.

The attorney general could care less about off duty cops drinking and driving or maybe you actually believe that cops never do, don't be naive. I don't make excuses. I'm an active citizen. I organize, promote, and attend public discourse programs, write my congressman, senator, and other law makers, all while holding down a job, a family and more. I don't just complain about having my constitution shredded before my eyes, I do something about it. I bet you think FISA protects Americans, that the military commissions act is good for us, and of course I bet you even support the patriot act. Trade security for freedom, right?

The question never asked is: does the gummint have the constitutional AUTHORITY to do this? The news team only wanted to ask the question "is it fair?" which is a subjective, debatable evaluation.
Almost everyone will agree that drunk drivers are misbehaving and deserve some sort of punishment. However, this new policy is an incredibly dangerous precedent to establish, right up there with allowing one human being to unilaterally declare another human being an "enemy combatant".

It's basically pre-crime. It's actually a very low percentage of people who drink and drive has accidents. These DUI laws were the first set of laws to ignore the constitutional tights of American citizens.
Google "DUI Exception to the Constitution" Alcohol will probably be outlawed with in twenty years.

well ret the united states already outlawed alcohol during the 20s under the 18th admendment and they thought it would bring the crime rate down but instead it brought the crime rate up (irony) so they abolished prohibition under the 21st admendment so now they cant prohibit alcohol consumption or the sale of it any more

If you know of cops who do that, then it is your civic duty to turn them in. The next time you see it happen, have a video camera handy and video tape them.
Why do you generalize us? We think that we're above people? That is the farthest thing from the truth. I don't think that I'm better than anyone.

I said 1 out of 7 because my father was a good cop. He told me about the rampant corruption in departments all over the country. You might fool other ppl with this kind of rhetoric but I'm not fooled. I said "all corrupt" because I know that 1 of 7 don't take on the other 6, it's something my dad regretted not doing more of the time. And b/c of that, he taught me that inaction is as bad as doing it yourself. If you've never seen this corruption then stop parking a desk, it won't take long.

76 were charged with dui. Of those 76, 39 were served with a warrant and forced to have their blood drawn and tested.

39 were served with a warrant because they exercised their right to "refuse". However, the judge found suficient evidence existed for a warrant to be issued to take the blood.
Get ready people, we are getting sick and tired of alcoholics getting behind the wheel and killing or seriously injuring our loved ones.
You don't want to get DUI's, stop drinking and driving. It's that simple. Or continue, but don't expect any sympathy from law enforcement or the courts.
