It is a firestop whether you agree or not, obviously the insulator and the building inspector have more experience than you. Ever stuffed fiberglass into a pipe and blown? It will seal better than most of the things you just listed. If your going to pick that house apart, than start with the fact there is insulation in it before it even has gable sheething, actually double walls like that one are rare if you have a descent builder or framer. Why pick apart that little peice of insulation?
