  • Cops can't just "check out" gun calls. The Constitution and Supreme Court both say that you can ONLY detain someone if you have a reasonable, articulable suspicion of a crime. Owning and carrying a gun is not that. He was illegally detained and the cops violated his rights.

    They can't "check out" gun calls this way anymore than they could search your car "just to make sure" that there was nothing illegal. That's why we're "innocent until proven guilty."

  • The guy had a CCW permit what exactly is the problem? The cops should have sent him on his way as soon as they looked at his permit. Open is carry is legal in Ohio anyway.

  • They charged him with failure to notify officers of conceal and carry license, which he CLEARY notifies them in this tape not minutes after they pick him up off the ground like a criminal. Evidence that the Oregon City Police tried to supress from evidence. Lucky they dismissed the criminal charges agains Mr. Sayers, they would have even a bigger lawsiut against them right now.

I listen to the scanner all the time ... everything reported back by dispatch is standard practice on all stops ... they check for warrants, registrations, insurance ... and yes if there is a firearm involved they run the serials ... and if capable they check firearm licenses ...

  • Ok ... I'll give your brother two things ... #1 complaintants over reacted ... the mere existence of a firearm in a house or a car absent it being brandished or actively used in a crime ... is NOT a reason to call 911.

    #2 - given the fact that they performed a felony stop and were likely not able to hear him ...

    given the fact that he is obviously knowledgeable about gun ownership and handling ...

    I am fully willing to assume that he in fact did notify them....

    The only thing he did wrong was give them his ID and consent to them running the serial number on his gun. They had no right to it.

  • All this shows is that more citizens need to start carrying openly. It gives the cops an opportunity to learn the law and it shows that law abiding people carry. The only reason this happened was because more people don't open carry.

Cops have had "accidental kills" due to improper handling of firearms (including one 12-yr-old kid shot in the back with a 12 guage shotgun while lying face-down, handcuffed, on the floor!) People PROPERLY trained in gun safety know that you don't point a gun at anything you don't intend to shoot.

    These cops are dangerous, unprofessional and should be horsewhipped, fired and jailed.

  • That's why it's hilarious that people are more scared of everyday citizens having guns than cops. Cops have no clue what they're doing with guns half the time. Citizens who carry are usually better informed and have better aim...and way more common sense than to point an assault rifle at passing traffic.

    They have no right to detain someone to "figure out what was going on" without reasonable, articulable suspicion that a crime had been committed. Open Carrying is NOT enough. That's why the charges were dropped.
