  • The other thing is that a junction like this would have had white lines painted on it directing drivers where to go so that situation such as this would not arise. Some call it the nanny state, but it probably would've prevented the dented wing.

  • Haha because crossing 4 opposing lanes of traffic at 70mph is much less dangerous than crossing 2, checking and then crossing/joining the other 2. What is possibly gained (apart from fines) from saying you're not allowed to stop in the central reservation? I'm from the uk where stopping (if you need to) is the accepted method at this type of junction.

  • How weird...in Oregon you're allowed to use he center lane to wait for traffic to clear. In fact, you have to do it during rush hour otherwise you wouldn't get anywhere.

    I agree that the rules of the road shoudl be defined nationwide, maybe by the DOT, and all states should be required to model their traffic laws after the nationwide standard.

  • @rraaffbb Yes. The laws surrounding the operation of motor vehicles are set at the state level. Some states allow you to enter an intersection on green and wait for oncoming traffic to clear before you make a left turn. Some don't

    Some consider states will only ticket you if you pass the stop bar while the light is red - some states will ticket you for being inside the intersection when it is red even if you entered on yellow.

    Some states allow right turns at a red light, some don't.

  • one time a accidentaly tapped a middle aged womens car door with a shopping bag, when me and my dad were walking away i turned around and saw hitting our car with her door and scrating it with a key. it cost us $850 in the end.

  • Yeh, you can't pull out to the middle of the intersection. Same with a left turn green arrow for a left turn with a light. Once must wait until traffic is clear in both directions. It is dangerous pulling out into the middle of the intersection for a left turn. One could be side swiped or killed by oncoming traffic. Just my two cents.

  • I never understood why people pull out halfway for any reason at all. It's traffic impediment. But the other guy does need anger management. ^_^

  • I assume you probly cut him off by saying you got in his way. Not really knowing the story in detail, still the guy was a idiot doing what he did. Rather him having a bad day, good day, or just a ok day he got what he deserved. Road rage is a waste of time and for people who promote it really are unhappy with themselves. Anyway those of us who drive have made mistakes on the road and if some driver says they haven't than there're a liar. But to think road rage will make it all better is wrong!

  • It took me a couple times watching the first 20 seconds or so to see what you meant. At times when you have to get across a busy 4 lane roadyou get in the middle. I have done what you done a bunch of times. I understand your thinking busy fast road easier to turn behind you. You were out of the way, like I said I done this a bunch and never had a problem. The guy misread your driving or didn't think what to do.

    There is no legal legitimate claim to "misread" driving or nothing thinking about what to do. There are legal rules of the road that you must follow. It doesn't matter if you do something you feel is logical--if it's illegal then it's illegal.

    The legal rule of the road here is to treat the median area the same as the road. Scruit should have pulled out and kept to the right. The truck should have passed Scruit on Scruit's left like any other roadway. Scruit is at fault.

  • @launchpaad88 According to the letter of the law, you are wrong too. I should have stayed behind the stop sign until I could make my left turn in one motion. The reason I went left is that the roads do not intersect at 90deg and my staying right I would have made the pickup have to make a slower and sharper turn. By moving to the left he could make a faster and shallower turn behind me. Most people appreciate this gesture.

  • @besquell You'd have to know the intersection. By pulling forward I actually gave him more room to complete his turn behind me, however he was set on going in front of me. The road intersects at a slight angle, so going behind me reduces the radius of his turn and makes it easier for him. By going in front of me, even before I moved forward, he has to slow down much more and make a much sharper turn.

  • @Kartracer6 There are lasws against intentionally damaging someone's property - that makes it a crime. In Ohio:

    2909.07 (A) (1) covers Criminal Mischief.

    (No person shall,) without privilege to do so, knowingly move, deface, damage, destroy, or otherwise improperly tamper with the property of another.

    "knowingly" basically means intentionally in this case. If the damage was accidental then it wasn't "knowingly".

  • Dude, you were blocking the other driver's ability to exit the road. You should have gotten a ticket for your share of the blame. To come on here and act like you're some kind of hero is pretty bad. The guy had every right to be pissed off, and to exit his vehicle. He could have even argued that your vehicle prevented him from exiting his vehicle, as well as the road, so he had to use equal force.

  • I took the blame (several times) in the video captions and in the description, for the driving maneuver. However as is didn't result in an accident it's irrelevant . No harm, no foul, move on.

    He had absolutely no right to get out and approach me in an agressive manner, nor to intentionally damage my car - an opinion shared by the police and courts and evidenced by the Disordely Conduct and Criminal Mischief charges.

    The police and courts would explain it to you too, if you did the same.

  • Self-Defense is meeting force with equal force. If I guy were to go off on you in a yelling rage shooting him would not constitute as self defense. I agree that Gun control laws don't work but you also must be responsable with guns. also if you did this incident and the other driver "went off on you" don't you think your still responsible for escalating this incident?

  • Generally, you cannot use deadly force unless deadly force is used (or is imminent). Different states/countries have different rules (some allow it to stop a rape, some don't. Some say you can't shoot someone who only has a knife, other say deadly is deady regardless of weapon be it a gun/knife/kick in the head etc) - but I know of no legal system that allows deadly force in response to swearing or vandalism.

    I'm a UK expat but I prefer US self defense laws. Still, must be reasonable.

  • There are many laws that the police don't have the time / energy / motivation / funding / (whatever) to enforce. That becomes an issue in and of itself.

    Accidents happen when someone does something unexpected. Around here there are many places where almost everyone breaks the rules that the one person actually complying with the law is unexpected and can cause accidents.

    I can't count how many times I've nearly been rear-ended stopping at a stop sign. You're expected to run it.

  • Reasonableness is up to the jury. In Ohio (where this video was made) the attacker must have means, motive, opportunity and you still have a duty to not escalate and a duty to flee.

    In this situation I'm ok from the attacker-motive and duty-to-not-escalate perspectives, however the attacker has no visible means of doing me deadly harm, nor am I aware of him having any opportunity to deploy the non-existent weapon. Further, I can back up and drive away.

    Deadly force is not justifiable.

  • In some states you can use the center turn lane as a staging area to make a left turn onto a road.

    Example: RCW 46.61.290 3 (a) states: ... A two-way left turn lane is near the center of the roadway set aside for use by vehicles making left turns in either direction from or into the roadway.

    Emphasis on the last 4 words: "or into the roadway."

  • Actually yes, to the best of my knowledge that maneuver is legal here in CA. Not only that the state encourages it by sometimes placing special lanes on the left after the intersection. Where you can stop and yield to though traffic, or use it as an acceleration lane to merge into trough traffic. Personally I think its dangerous. Regardless if legal or not, the driver of the that white truck is so far out of line. It's ridicules.

Although I don't know what would happen if this was in CA, because even if stopping there is allowed, the white truck is bigger than the black car, so he has priority (in California) because it's harder for him to come to a complete stop.

  • The trooped said the key difference is it was a stop sign, not a traffic light. If it was a green light then I could creep into the intersection to wait for oncoming traffic to clear.

    In this case I was setting off from a stop sign so I could wait for side traffic to clear. He said I have to wait behind the stop sign until I can clear the intersection in one maneuver.

  • I wish I could do what you're doing in PA. I don't know if I mentioned this before but two kids were arrested and charged with felony wiretapping for taping their traffic stop in Carlisle, PA. It's unlawful to intercept and record audio without the other party knowing AND giving consent - and as you are probably aware, most law enforcement officers FOR SOME REASON always tell you to turn the camera OFF.

  • The officer asked me to turn the camera off, and I did. I later checked with the local city prosecutor hadnling this case and he told me the police have no power to force me to turn off the camera unless it's interfering with thier duties.

  • Only reason the officer wanted the camera off was so he / she didn't get recorded. The camera would not have interfered with anything as you didn't have the camera out there sticking in their face. The camera in my car can't be seen from outside very easily unless your looking for it.

  • One extra fact, most employers don't hire on convictions. Why hire someone with a criminal conviction? For example, two shop lifting conviction are bad because it indicates you steal. With a tight job market, why as an employer would I hire a hot head? Today you can not hide from convictions, EVERYTHING is in some database, the toothpaste you buy, your latest movie rental and yes ALL criminal proceedings even no-contest/no criminal record plea bargains are recorded by private companies, STUPID.

  • In some intersections you can come out halfway to the protected median if the road is too wide/fast to safely pull out in one go. Event he officer said that he understand that everyone does it and it's safer that way, but the law is the law, regardless of how well it matches real life. I no longer pull out half way (now that I know the law) but some times I can be waiting at this intersection for 10 minutes waiting for both directions to be clear long enough to cross and get up to speed.

  • In the UK, the Police would never attend something like less. Unless there's "damage to the road" (whatever that means) or someone is injured, they just refuse to get involved. This is why I now also film every journey. What has the UK come to?

    It's the same in the US and the UK. A car accident is civil, not criminal. Unless there is an injury, a risk of injury or an actual crime (as above) the police in many jurisdictions won't attend - they have you download a form to fill out with the accident details.

    In this case the first 911 call brought a State Trooper to respond to an accident / blocked road. He punted to the County Sheriff when he figured out it was a crime, not an accident.

His argument was that I had pulled out from a side street and wait waiting in the median. I thought it was ok do that.
