I did a piece in the mid-90's for an Emmy-award winning news outlet. That was subsequently rebroadcast in whole, on an unscrambled satellite channel by a "subordinant governmental body " that claims to be educational. From what i understand, I could have nailed them even if they claimed "Fair Use". DMCA strengthened things since then so

Still, that has to do with the YouTube ToS and nothing to do with fair use. Fair use has to do with the legal system whereas the ToS is just website policy - in essence, a contract between me and YouTube.

In other words, somebody else couldn't sue me if I violated the ToS - only YouTube could, and I am willing to bet that they won't. And there is nothing in fair use standards that even mentions ToS.

Trust me, I've talked to a lawyer about this stuff.

Just imagine if it did! YouTube can literally put anything they want in the ToS. They could say, "It is against this ToS to call any YT user a 'douche'"

Now, if you called a YT and if the ToS had bearing on the law, then that user could sue you for calling him a douche... which would of course be unconstitutional.

Sorry. I was just trying to draw a comparison, and maybe didn't have enough space to properly clarify. Let me rephrase:

YT can pretty much put anything in their ToS that that they want, but this has no bearing on the actual law. So, if they put a clause in the ToS saying you can't call somebody a douche on YT, and you violated this clause, the user that you called a douche couldn't sue you for breaking the YT ToS.

Only YT can sue you for breaking the ToS because it is basically a contract.

I've gotten through to them on 3 occasions. Here's how you do it: send the message to everyone who the DMCAabuse channel is subscribed to. You have to change it a bit because of youtube's spam filter, but someone will respond and contact the right people. Most importantly, contact DPRJones, and make the subject "FALSE DMCA IN PROGRESS".

Make sure you visit the LeagueOfReason as well.
