I went through one of these on my way home from work and they let the car in front me go ahead through but when I pulled up (I still had my work uniform on) they made me pull off to the right checked my ID and rain my license plates then finally let me go it was a little rediculis considering I had my uniform on still

Asking for a lisence is just a way to know who you are, which if when an officer askes for an ID you must present one to him. If and officer at any time has reasonable cause such as seeing drugs or weapons they have the right to "stop" and or "detain". As for showing ID the person in this video was involved in a "stop" even though they didn't detain him. This means that during that "stop" in which he whe was driving a motor vehicle he is required by law to produce drivers license. Failure to do so is illegal on your part not the officers.

The courts have ruled checkpoints legal. I disagree with them, but they have.
The logic is that reasonable suspicion and probable cause are meant to control an officer's discretion. Since road blocks do not involve any discretion on the part of the officer as to who they stop, they are then therefore exempt from such restrictions.

Several young ladies told me that he hugged and grabbed them. He tried to threaten me. I let him know that when he's on my clock, I'm the law and then I fired him. I also called the local sheriffs office and let them know what he did. I didn't hear anything else after that.

I live in costa rica and since 4 years we have to pass inspection with our car every year or your car does not get the permissions. Costa Rica was the country with the highest traffic death rate of the world and things have improved MASSIVELY. Before wehad no controls at all. But checkpoints are to condition people

When the Supreme court declares that the point of a DUI check is merely to check the sobriety of the driver, and that any other verification (license, registration) is a viaolation of the driver's right to free travel. Taking restrictions by a license means surrendering a right. Why would anyone give up their right to travel for a license to be restricted to drive?

And one more thing- I would NEVER move my car to the secondary area. I would either be set free or get arrested in the lane of traffic. Moving to the side area gives them all the time they need and can move you out of view of the public. Just as with street criminals- NEVER be taken to a secondary area. Let everything that's going to happen occur in a public place.
Great job! I would offer two recommendations, however. First, when the officer said that you were not being detained, I would have said, "Great! Have a nice night." That would force them into a catch 22. Secondly, when the sarge came to your window and began spewing lies, I would have totally clammed up and taken the ticket or arrest. Then you can civilly sue the bastard. Sometimes you have to risk arrest to get them over a barrel. Suing them is the best way to go. Keep it up!
How are these checkpoints even legal? When I hear the word checkpoint I automatically reach for my shotgun and head for the hills. If the pigs weren't making money on DUIs there would be no enforcement. Nothing is done in this country for free!

DUI checkpoints should not be required to be advertised. At all. This is an excellent way to get silly death causing drunks off the street, and giving warning to them is not fair to the law abiding responsible people who inevitably become their victims.

I thought you had to have a Drivers License to operate a vehicle? a police officer can fine you if you are not driving with a license. If I am driving, hell yeah I will show a cop my license. If I'm walking around, I do not have to show my ID to anyone, or even have an ID on my person.

It's a contract you enter into when getting a driver's license. So, are you saying if these cops encountered the FBI's #1 most wanted person during a DUI checkpoint, they couldn't arrest him unless he was driving drunk? Asking for a lisence is just a way to know who you are, which if when an officer askes for an ID you must present one to him. If and officer at any time has reasonable cause such as seeing drugs or weapons they have the right to "stop" and or "detain". As for showing ID the person in this video was involved in a "stop" even though they didn't detain him. This means that during that "stop" in which he whe was driving a motor vehicle he is required by law to produce drivers license. Failure to do so is illegal on your part not the officers.

The courts have ruled checkpoints legal. I disagree with them, but they have.
The logic is that reasonable suspicion and probable cause are meant to control an officer's discretion. Since road blocks do not involve any discretion on the part of the officer as to who they stop, they are then therefore exempt from such restrictions.
Yeah, I disagree, but the law as ruled is law; our feelings on the matter don't change it.

Several young ladies told me that he hugged and grabbed them. He tried to threaten me. I let him know that when he's on my clock, I'm the law and then I fired him. Great job! I would offer two recommendations, however. First, when the officer said that you were not being detained, I would have said, "Great! Have a nice night." That would force them into a catch 22. Secondly, when the sarge came to your window and began spewing lies, I would have totally clammed up and taken the ticket or arrest. DUI checkpoints should not be required to be advertised. At all. This is an excellent way to get silly death causing drunks off the street, and giving warning to them is not fair to the law abiding responsible people who inevitably become their victims.

oh, and they can use a DUI checkpoint to screen your vehicle for equipment violations, warrants and expired inspection stickers, if they happen to notice it. If that was me I would at least write you a ticket for not having your insurance card on you, and if I couldn't reach the insurance company your car would be towed just because you decided to be a smartass.

@TomKreder you are wrong sir, once it is established that the driver has shown no signs of intoxication, according to the letter of the letter of the law, he should be permitted to depart without delay. the police cleverly use one of their test questions as "can i see your license?" which you may answer "no". its just a question, not an order. the line when a question becomes an order is never established. pa is not a "stop and identify state. it worries me if your a cop and dont know this.:(

I thought you had to have a Drivers License to operate a vehicle? a police officer can fine you if you are not driving with a license. If I am driving, hell yeah I will show a cop my license. If I'm walking around, I do not have to show my ID to anyone, or even have an ID on my person.

@Tsaier the point is that they are not allowed to use the checkpoint solely to scan for drivers licenses or equipment violations the checkpoint is for intoxicated drivers. when they observe that youve shown no signs of inebriation you should be allowed to continue on your way without delay. only if the officer has probable cause to suspect that you have or are going to commit a crime may he order you to produce i.d. these guys sidestepped the rules too many times to count in this video

It's a contract you enter into when getting a driver's license. So, are you saying if these cops encountered the FBI's #1 most wanted person during a DUI checkpoint, they couldn't arrest him unless he was driving drunk?
