Daniel Martin appears to be an out of control cop by any rational standard, but despite this, Mr. Douglas should have yielded to Trooper Martin's demand. Reasonable people can see a peaceful outcome would likely have occurred if Martin simply allowed Douglas to pass by. Yet Trooper Martin's discretion on the scene is in the public interest, and Mr Douglas chose to ignore a lawful order. The use of force should not be in question, though the level of force is clearly excessive.

As I see it, there are degrees of 'wrong'. Trooper Martin was not wrong at all to assert his authority over the vicinity of the traffic stop. The manner in which he did so was a little 'wrong' at first. As the incident progressed he used excessive force which was much more 'wrong'. My statements are not contradictory. Daniel Martin is not the problem, Oklahoma Highway patrol is. The police officers both acted unreasonably and aggressively for no reason what-so-ever, one can thus conclude that the aggressive tactics they use are sanctioned by the Highway Patrol itself.
I lived in OKC in the 80's, the OCP and OHP were known for aggressive tatics. I DO NOT agree with these officers actions but from what I have personally witnessed from OCP, the subject should have complied with the officers demand to retreat to the other side of the road until they were finished. The use of the baton was not justified and these officers just gave good LEO's a bad name.

Daniel Martin shouldn't be in law enforcement. He is a bad apple. However when police are conducting a stop and someone comes walking up, they have no idea who that person is. They don't know if it's Average Joe, a fellow gang member or anyone else. If you dealt with criminals on a daily basis, I doubt you would let people walk up on you either. Also the suspect immediately lied about who's house it was. Check the story. If you hate the police so much, please by all means, never call them.

this officer could have simply informed the gentleman who approached "you are attempting to contaminate a police crime scene (could use different words to reflect it's not a crime scene rather an investigation) if you attempt to come back before we are done conducting our investigation, you will be put down, handcuffed and arrested."

Evidently, trooper Martin hasn't learned his lesson yet. I didn't see excessive force at all and the police spoke to the guy very politely. The guy threw himself to the ground when the cop pulled him away from the fence. He planned to just walk through the cops when they told him to wait over there. He looks like the kind of guy who is used to pushing his weight around... literally. He deserved to be arrested. You must obey a lawful order and I don't see anything unlawful about the cop asking the guy to wait. Was there a remodel emergency?

Daniel Martin appears to be an out of control cop by any rational standard, but despite this, Mr. Douglas should have yielded to Trooper Martin's demand. Reasonable people can see a peaceful outcome would likely have occurred if Martin simply allowed Douglas to pass by. Yet Trooper Martin's discretion on the scene is in the public interest, and Mr Douglas chose to ignore a lawful order. The use of force should not be in question, though the level of force is clearly excessive.

As I see it, there are degrees of 'wrong'. Trooper Martin was not wrong at all to assert his authority over the vicinity of the traffic stop. The manner in which he did so was a little 'wrong' at first. As the incident progressed he used excessive force which was much more 'wrong'. My statements are not contradictory. The trooper went out of his way to START this incident. merely passing by is NOT interfering with writing a ticket. This is a simple case of a cop powertripping. They also state that the man beaten was on drugs and drunk. I do not see any evidence that supports that claim. The man beaten talks clearly to the police and states that he just wants to walk across to his relative on the relatives property about 30 feet away. The police are hiding the truth.

@michaelf1900 the problem is that cops have to really watch there back because they usually are killed during routine incidents so yes this seems like a simple situation but they never know someones intent especially when they have an attitude like this guy. i don't like cops and they abuse there power alot but the best way to solve this is to avoid them whenever possible. don't you agree with that point of view?

Daniel Martin is not the problem, Oklahoma Highway patrol is. The police officers both acted unreasonably and aggressively for no reason what-so-ever, one can thus conclude that the aggressive tactics they use are sanctioned by the Highway Patrol itself.

I lived in OKC in the 80's, the OCP and OHP were known for aggressive tatics. I DO NOT agree with these officers actions but from what I have personally witnessed from OCP, the subject should have complied with the officers demand to retreat to the other side of the road until they were finished. The use of the baton was not justified and these officers just gave good LEO's a bad name.
