stupid is as stupid does. If your mother, sister or daughter got shot wouldn't you want them to check every car to try to find the shooter. All they wanted to do is look inside the van to make sure the shooter wasn't in there. They don't want to check your van for drugs. They don't have time to search threw your shit. They just wanted to LOOK! Good job Mason County Sheriff's
@tigerlaker If you're willing to give up your liberties and freedoms for temporary protection, then you deserve neither. Those aren't my words, those are from Benjamin Franklin. The police are legally allowed to lie to you to get what they want, so you saying that they don't want to look for drugs or anything else is naive. "...any lawyer worth his salt will tell the suspect in no uncertain terms to make no statement to the police under any circumstances." Robert H. Jackson
Be thankful it was NOT the Seattle cops, Nick! You come into our area, use the trails to ride your ORV, complain about your rights. In the meantime you refuse to comply and whine about everyone letting the cops look in their vehicles. You came out of the area where the shooting took place, you drive a van describe as the same that the shooter had. You were told politely by the Mason Cops why...and all you are crying is your American you have rights. Kind of like calling the "race card" eh?
A man had just shot his girlfriend and escaped in the area and police were concerned he had hidden in someone's car. They asked if they could look in his vehicle and he said no, which they respected. They were well within their rights to then detain him until they could get a warrant. No one's rights were violated.
if u think these cops whr in the wrong then ur a dumb ass! if it was ur wife, sister ,mother who got shot u'd want everything done the same. i am an EX-con with a long record and i would of let them LOOK IN MY CAR! thats all they did was LOOK!
@Darathin: I am not aware of any excerpt in the WA State Constitution that bans roadblocks. I am aware of the Supreme Court case "Michigan v. Sitz" which found DUI roadblocks to be a minor violation of 4th amendment rights. However, this ruling addressed stopping people without cause. This was not a DUI roadblock. There was a clear cause for the checkpoint, which was ceased once they found the suspect.
@superguzzi07: I was addressing the detention of the two fanatics in the truck. They had every selfish right to refuse a search of their vehicle. They also had every right to allow the officer to search their vehicle. But since they refused, the officers had every right to detain them. Just because you have the "right" to do something, doesn't mean you have to choose that path, or that it's the most moral choice.
@kookoonuts If I have the right to refuse being searched, then it cannot logically follow that the police have the right to punish me for my choice. It's not a right if negative legal consequences follow the rightful action. The officer was wrong to detain me for acting within the scope of the law, it constitutes an unlawful detainment.
Okay as I was there in Belfair at the same time this happened I know what happened. The cops where looking for a guy who shot a lady and then got into a wreck. So clearly he didn't care about anyone’s safety. He then ran up into the woods in that area. So instead of causing a problem all you had to do was let the cop look in you van and boom you could have gone off to where ever you were going.
"If you can get a warrant, then you don't need my consent."
Their actions make it clear that they didn't believe there was even the slightest chance that a desperate shooter inside the van. You and your buddy were left unsecured while a lone officer waved other cars through as quickly as possible after a brief glance into their passenger compartments. (They can do that based on case law, but they cannot force further searches.)
@NHindividualist, The Mason County Sheriff office runs on bare bone budget now...and thanks to the Mason County Commissioners they have pass next years budget 2012 cutting the sheriff departments budget AGAIN. It's alleged we (Mason County) have no place to put people if arrested, we have beds, but we have no one to monitor those prisoners in those beds. Isn't that a shame? Thank A Commissioner of Mason County!!!
@msglaigaie You're absolutely right: the shooter would roll up on the LEO with a bright, flashing neon sign saying "I'm the guy you're looking for. Pick me, pick me!" When there is a traffic stop, they stop and search ALL vehicles, regardless of age, race, gender or lack of understanding of the U.S. Constitution. The guy posting this video had every right to decline, but he shouldn't be a whiny bitch when LEO responds appropriately to ensure public safety.
You are a fucking idiot... Lets play a stupid little game and waste the deputies time while an armed criminal gets away. You and that little inbred butt buddy of yours are whats wrong with America these days. You really need to get a life.
@nozzleman2149 Nice mouth. What is wrong with you? A man stand up for himself instead of getting in line with the sheep and YOU get upset? I suppose the shooter was also out three wheeling and was attempting to escape while towing a trailer.
@msglaigaie ~ the shooter was also out three wheeling and was attempting to escape while towing a trailer. It's been known to happen before in Belfair!
The man standing up for himself, left the same area as the shooting, drove the same tytpe van that the shooter drove. What was the sheriff suppose to do? Personally, what a perfect place to come and play... * heard women in the back of the van. Maybe there was someone in the van that didn't want people to know they were there. hmmm.
Funny how people stand up for their "Constitutional rights" without knowing the Constitution. Article 1.9 specifically says you can be detained in the event that public safety requires it. Guess what: the LEO were operating completely within the bounds of the constitution because the public was at risk. And you know what sucks? You WASTED resources that could have been used to find the shooter. How selfish. How ignorant.
@kookoonuts Article 1, Section 9 actually addresses the provisions for the suspension of Habeas Corpus. "The privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it." It does not set aside the fourth amendment (unlawful search/seizure) or the fifth amendment (presumptive innocence). While the poster may come off as a whiney twit, he cannot be compelled, unless under arrest, to submit to a vehicle search.
@kookoonuts Try reading the Washington State Constitution, under which the WA state supreme court has repeatedly banned road blocks and the kind of warrantless searches being demanded by the thugs in uniform.
Congrats! In that 10+ minute video you managed to waste our time AND in that time you had to "defend YOUR rights", you took that officer, who could have been looking for the suspect, and wasted his time. In that time they could have found the suspect sooner. Oh, by the way, looking at all those cars in the back ground, it took about 5-10 seconds to look in and then they were gone, instead, you took 100 times that to get detained. Congrats! you FAIL!
You're an obnoxious idiot. Thanks for wasting my tax dollars just to prove you know your rights. If you have nothing to hide, what's the problem with letting them peek into the van? No wonder you live in Mason County..
Thank you for standing up for your constitutional rights. Positive it was a hastle. You were respectful to LE. When the suspect was located, that should have been the end of it. I am wondering what the outcome will be. I bet they almost fainted when you said you were armed.
This guy was a stupid f''n idiot, He pulled this stunt and held up traffic, and slowed my daughter making it to the urgent care with my granddaughter all because his stupid rights, he doesn't deserve the rights, This guy is nothing more but a drunk drama queen, I think the cops should of made him take a sobriety test,......and impounded his quads, and van, I hope he does not represent Belfair, We are not idiots here in Belfair, Stay out of our play areas jerk
@gvenglar Your Grandkid is nothing when compared to the rights and freedoms guranteed by the Constution of the United States of America. It's weak ungrateful selfish bottem feeders like yourself who aut be called out as an idiots. Remember the power in this republic comes from the people and their RIGHTS, all of their rights. You can't cherry pick rights baised upon a selfish whim.
@zaq1967~ Seriously? A human childs life is "not nothing when compared to the rights of freedoms guaranteed by the Constution of the United States of America" SHAME ON YOU, A CHILDS LIFE???
@gvenglar I'm glad you told that story and hope your granddaughter is okay. I guess these "out of towners" had nothing better to do, beside go home. It's one thing to have our "rights" and I agree with that, BUT to refuse a simple request to see if the shooter is in his "white van with no windows" was a stupid move. Hopefully he has learned from this, NOT IN MASON COUNTY. They are not playing...when it comes to shooting or murdering someone. Remember the murder of 3 people in View Ridge Heights?
@gvenglar I was not holding up traffic, the police were. I just wanted to leave. The police could have made this situation easier for everyone if they would have used real policing skills and limited their actions to those outline in our state constitution.
@alexzbabygirl6900, apparently on the 2nd video he explains that they did find the guy and that was the end of getting a search warrant. But it was also a hassle for those who do not comply when we have a crisis in Mason County. Good Job Mason County Cops.
Where in the Constitution does it say that your "right" is to obstruct in the apprehension of a shooting suspect. How much did your obdurance cost in time and money an already overextended Sheriffs Department?
I believe my rights are mitigated when they begin to harm others. Especially when there is no good reason to do so.
@parris6669~there are only those 2 roads at the intersection. The only way out of Sandhill is to drive back up to the area where the shooting took place. This is very rural area & was an easy stop. Obstructing justice is NOT a right... and even though you have rights as an American there are other Americans who also pay the taxes that you wasted, by failing to comply with the deputies request. Us tax payers should have the right to sue idiots who interfer in crime scene investigations
@Springer228 First of all, I only commented on which road this was on. I wasn't pulled over or in this video. If it were me in this case I would've let them look. But where do Americans or Tax payers as you put it, draw the line on our rights being infringed upon? Congress are signing bills left and right that suspend our constitutional rights. Just sayin'...
I don't miss Belfair. That's for sure.
