Yes, you do. ROMs are illegal to have unless you have a physical copy of the game in your possession. Also, the ROM can only be used by you (or the owner of the game).

For any 2.x user the iphysics app store version has just been released it costs like 2.99 but it's a lot better than this one

In the old summerboard you could turn that on in the SMBprefs, but now if you have 1.1.4 you can just move the icons with the jiggle feature.

The apps and such take up a very small amount of room. Although I think it'd be worth it to get a 32 gb just because thats double the amount of music (or video).

I am the 16gb iPod Touch only. Both work exactly the same, but I would recommend the 16gb iPhone because you get the camera, and if you are in a place with AT&T you can actually use it as a phone.
