It depends on each individual case, as you would imagine, but I know -in my friend's case, for example- he couldn't apply for asylum, even though he comes from a politically troubled country. Why? Because after his visa expired (a 30 day visa, that is) he was ADVISED by IMM LAWYERS NOT TO APPLY (hence, remain illegal) because ever since after 9/11 immigration processes like his were doomed, bc Imm judges usually oversimplify decisions by applying enforcement only.
