I think in Season 5 episode 5, it's stated that Victoria and her father had a "trial separation" [what Brooke said to Lucas]. So I'm guessing that Victoria and Brooke's father are divorced.
Maybe it's because Victoria got full custody of Brooke. Brooke also said in another episode that she had a parent who resented her and one who cared more about her golf score than care about her [I'm guessing that's her father] so it would make sense if Victoria really does have custody over her.
