@marvinfloyd Knowing the difference between right and wrong isn't the issue. The P said it was legal for her son to drive on their own property because she claimed to have a city permit allowing it. Her son gave the girl the same info "it's legal for me and you to drive on our property because of mom's permit." So the girl was convinced it was legal. His mom had been facilitating this incorrect notion, while allowing them in a car with keys. Mom's legally (and morally) at fault.

A fellow officer tried to charge some kids for driving without a license on some old logging roads on private property. it was thrown out of court.

The "boy's consent" to leave the property doesn't matter since he's a minor, and it doesn't amount to the plaintiff's consent. The fact that the mother negligently left the keys in her car while children were around, and negligently did not supervise the children reasonably well enough to keep them from harming/killing themselves puts the plantiff on the wrong side of the law. The guilt was probably too overwhelming, so she blamed the dead girl.
Judy blew it. why didn't she simply state that the boy's consent to leave the property amounted to the plaintiff's consent, or something to that effect?

Her son gave the girl the same info "it's legal for me and you to drive on our property because of mom's permit." So the girl was convinced it was legal. His mom had been facilitating this incorrect notion, while allowing them in a car with keys. Mom's legally (and morally) at fault.

The "boy's consent" to leave the property doesn't matter since he's a minor, and it doesn't amount to the plaintiff's consent. The fact that the mother negligently left the keys in her car while children were around, and negligently did not supervise the children reasonably well enough to keep them from harming/killing themselves puts the plantiff on the wrong side of the law. The guilt was probably too overwhelming, so she blamed the dead girl.
