YouTube has taken reasonable measures to ensure that copyrighted material isn't uploaded on it's site. They have warnings when you go to upload a video. It's written in the Terms of Use and in many other places as well. The people are warned. They also try to monitor it as much as reasonably possible. Viacom, along with other copyright owners cannot expect YouTube to screen every single one of the millions of video uploaded on the site. That is simply unreasonable.

What they are forgetting is that YouTube users are internationally based and not just American. In Canada, we have strict privacy laws which this ruling violates. I'm sure there are other countries that have strict privacy laws as well. This could get nasty if people from other countries start to get involved. I'm not too impressed that a judge from another country is allowed to make a ruling that violate my rights which are protected by law in my own country.

I know how poor the internal security is within many companies. This is endemic to the corporate culture and VIACOM is not immune. This information will be secured laughably poor and will result in someone else gaining access to it.

Stanton's decision is a combination of poor knowledge (the law is never up to date with technology) and poor interpretation of civil liberties.

IP addresses can lead to private info when it's already unlawful to get it without a proper subpoena.

Good Point. I look at it this way. Thy "Viacom" can now see the hit's and popularity of a users product. Copy the substance predate all the paperwork trademark and copyright and put it on commercial broadcast. The original creator will have very little or no recourse do to Viacom's deep pocket's and legal practice.

I heard that Viacom had an order in place that they couldn't do anything to the data except support their claim against google. And google gets a change to anatomize all the data. So, I don't know.
