  • you can not ask for a title of deed when you are in a Dispute of land with any group that have an agreement that goes back to 1784.

    which was a agreement with the British Crown which still governs of Canada weather you'd like to admit it or not.

If the government truly was in the right then they would act swiftly but they clearly aren't. If the natives tried to claim Toronto using these same tactics then believe me the police would act. When you know you are guilty but are physically stronger you stall and hope to outweight or intimidate the victim; Canada tried both and failed.

    If in Caledonia, we are talking about agreements made between the British, and the Six Nations, in 1783/84 it's obvious that these treaty's were never written to include An independent Canadian State. What you have in Caledonia and anywhere these issues exist is self sustaining, parasitic bureaucracy. Lawyers and other Municipal, Provincial and Federal Bureaucrats are simply milking their own system.

  • I beg to differ, in your original post you said "the government charges property...taxes FOR continued title". But, this is plainly not correct, as you admit in your later posts. De facto and de jure are not the same thing. And there is no such thing as "anti-trespass laws" for an Anti-Trespass law would in fact be a law specifically condoning trespass. Furthermore, Hydro is regulated and distributed by a Crown Corporation, and the infrastructure is thus a public supported (in part) by taxes.

  • Unfortunately, "property" is not as clear as this man would like to think it is. Unfortunately, he also fails to understand that this is a political rather than simple "legal" issue. Law is simply policy implemented, and the policy of the Government of Canada, and of Ontario, is not clear cut on this type of issue. This is a way more complex issue than this fellow wishes to acknowledge. Unfortunately, for this fellow, his understanding of the interplay between law and politics is black and white

  • First off, I am glad to see that you foster democratic debate and open dialogue. Secondly, I am white. And, thirdly, I am rather conservative - especially fiscally speaking. Despite my being white, and conservative, I am able to see the sense in other people's arguments.

    Secondly, law is shades of gray. While its application is most often black and white its development is always subject to debate (parliament repeals and forms 100's of laws a year). Even its application is subject to discretion

  • The difference is, and the point that you missed, is that, unlike some conceptions enshrined in the law - such as the rule against murder - the rules regarding land law in Canada are subject to dispute over 'ownership'. In a democracy, subjugation to the rule of law is premised on a broad notion of consent and cultural reflection. No one would obey a law requiring one to do something that did not accord with the cultural norms of that society.

  • Your point misses a further important aspect - that is that not all matters of ownership are equally in dispute. A person who lives in the Rural Midlands of England has a far more secure title (that is, entitlement) to the land than someone in the disputed territories between Israel and the Gaza Strip. That land is clearly in dispute. So would an English colonist's title to lands in Northern Ireland be hotly disputed by many Irish.

  • You got it backwards. The issue here is that the government charges the property owners taxes for continued title to the property, but refuses to enforce anti-trespass laws. This is called fraud on my books.

  • Taxes are not for title, or title protection. Taxes are for services, such as roads, hydro infrastructure, snow removal, and the like. The reason you are confused about what taxes are for is because the Government (depending on whether you owe federal or provincial etc taxes) may lean your property, impose fines, or even expropriate your property for non-payment. You don't "pay" taxes for title - its not 'rent'.

  • Try to repeat that over and over and you will understand: continued ownership of the title is conditional upon paying taxes. The use of the roads can be compensated for thru road tax, paid by the drivers, but its not and it's only marginally relevant. Snow removal is not always on the municipality. Hydro infrastructure is paid for by your hydro bill and connection charge. But in the end, the government takes possession of the title if taxes not paid.

  • For a black and white law man, you seem to be rather flippant about the divide between the operation of the law and the consequential results of law. But back to your original point, taxes are not payment for title protection and that is nowhere near the legal definition of fraud. Fraud is intentional deception resulting in harm. There is no deception here.

  • What you are missing is the fact that title deed disputes are only legitimate when more than one individual holds (or thinks they hold) a title to the same parcel of land, like in the cases where property lines were established by surveyor's mistake, or there was a mistake in the filing of the documents. But when one holds a title deed, but another thinks that his tribe's chief who sold the land to the govt 200 years ago was not legit, this is BS, not a title dispute.

  • Again, you presume title is the only method of acquisition or avenue for claiming an interest in land. That is plainly wrong. For ex. someone may claim a right of way over a property and thus acquire an interest in the land without any issue of title; someone might acquire an interest through continued use or adverse possession of land; through constructive or resulting trust arrangements, and so on. There is more than one way (in fact many ways!) to dispute title or exclusive ownership of land.
