I haven't seen Expelled yet (I was in the middle of some stuff when it came out and missed my chance) but I think I know why Stein makes that association between Hitler and Evolution. It stems from an old field of study called Eugenics. Eugenics taught that because evolution was true, there was naturally a superior evolutionary race, thus other races should be eliminated for the survival of the fittest. Hitler eliminated what he thought to be inferior races.

In answer to your question;

I'm not an expert on these things, but I think what most of us do on Youtube is protected by "Fair Use", which allows for the use of a small amount of a copyrighted material for the purpose of news, education, critical analysis and satire. Technically you're not even useing any footage from the movie and even if you did this would be "Critical Analysis".
