In the UK you must have a legal reason - not factual - to be able to get an appeal and it really rarely happens in one year. Giselle as a non practicing law grad is a bad Virgil. S/he believes that de novo review occurs only in the event of introducing new facts (wrong), that a right to apeal does not exist in the UK, and that Italy mandates a retrial. It is obvious to any native speaker on these boards that I am a practicing lawyer, yet poor Giselle must assert otherwise (just as s/he fails to fully acknowledge curtknox is a fraud). Taking each point he asserts one by one, anyone will see why reasonable doubt exists.

Along with this there are - mixed blood with Meredith's blood - mixed DNA - scratch marks that were on her body the day after the murder - the DNA on the murder weapon - the shoe prints - the phone calls - the DNA in the room the murder was staged - phone records that prove she did NOT call police - witnesses - forensic experts that testify this murder involved more than one person
Her claim of abuse by police was investigated - however Amanda could not identify the woman police office that allegedly hit her several times.
In any case the Supreme Court in Italy crossed the confession from the records. But Amanda has yet to produce an alibi. The first and most basic part of criminal procedures. OF COURSE because she was involved in the murder. When you eliminate the impossible you are left with only the truth - no matter how improbable
Amanda claims that she was with her boyfriend, Raffaele, the night of the murder. He maintains that she left his house at 9pm and returned at 1 am. Thus even her co defendant does not give her an alibi.
Where was Amanda when Meredith was murdered. This is the first question any suspect is asked and one that Amanda has yet to answer. NB she did confess that she was at home when Meredith was murdered and heard the screams, but she withdrew her confession and claimed she was physically assaulted.

This contamination that you like to speak of is a matter that must be raised by the defence. The burden of proof is then on the defence to prove that in fact such contamination has taken place. This is the case in most legal systems that I am aware of, it would be ridiculous to propose that the prosecution would have to prove that scientists have done their job correctly - as they are assumed to have done so. This is the same concept as guilty until proven innocent. No contamination was proven.
1) We are not talking about the procedural burdens of evidence but rather those aspects of the case that give one pause, and that make your often rabid assertions about Amanda's "obvious guilt" look shrill, mean spirited, and suspect. 2) It is precisely the various, obvious errors in what was done, what wasn't done, and how the evidence was interpreted (perhaps badly) that legal scholars agree will form the strongest case for overturning on appeal. I was not aware that there was a retrial of the facts in the States.... seems rather absurd because the right to appeal must be based on legal issues and not a dispute of the facts. The facts are for the jury to decide and therefore cannot concern a court of appeal.
In any case I do not concern myself with questioning the system - Italy has its own sovereign state and whether you like it or not Amanda has had a fair trial in accordance with the laws of the country.

Um, there most certainly is an automatic right to appeal for one convicted at trial of a capital crime in the UK. As for your last sophomoric statement, that is not true either. The scope of appeal for capital crimes in both the U.S. and the U.K. allows for a review of both the facts and the law.

As far as I was aware there were only two pieces of DNA belonging to RS found at AK and Meredith's apartment - one on a cigarette butt and the other on the bra clasp. Thus there was no reason to prepose contamination. In any case contamination is a matter that is to be proven by the defence in courts.
Also it was testified that the amount of DNA found on the bra clasp was significant and could only get there by RS actually having touched the bra.

In any case there is an automatic right to appeal in Italy, so there is no need to discuss grounds for an appeal. The second trial is almost a retrial and all the evidence will be reconsidered. I believe this is a better system than the UK and US for the defendants

As for your lecturing about legal systems, capital crimes in the U.S. afford the same right of review (an automatic appeal) as in Italy, which allows for a review of both the legal and substantive merits of the trial. Moreover, the whole point of a jury trial is to allow the accused to be judged by a jury of one's peers, and by as unbiased a jury as possible (requiring, de minimis, sequestration and little judge interference). There are sound reasons for sequestration and only non-judge juries.

There is no reference to foxy knoxy or anything else FOA want to blame the verdict on - pure factual analysis.

If anyone is interested in the facts that have been censored by the American media the judges report from Guede's case can clarify a lot of points. There is no censorship in America vis a vis reporting on Amanda Knox. That is an idiotic claim. Americans have set up sites that declare Amanda's guilt! The U.S. is not Italy. If you want the truth look up the Micheli report - there are english translations available on True Justice for Meredith Kercher site and the Italian report is available in a government website. There all the gruesome details and forensics evidence (160 pieces) has been revealed. Including the reasonings against the fairy tale reasoning of the defence.
The trial coverage was anything but "incredibly one sided" in Italy, where I live and observed the reporting on the proceedings. I and other Italian friends of mine, including lawyers and trial attorneys, do not see this in the hysterical black and white terms that you propose. I would say about one out of five of the Italian lawyers with whom I converse -- who have no horse in the race but have followed the matter -- think Amanda is completely innocent. You sound like a complete novice.
I have read the Micheli report and the defense attorney summations in the Italian, thank you very much. They are powerful, but not definitive. Knox stated that she spent the night at Raffaeles apart. when he refused to corroborate her story she then said that she was in the kitchen when Patrick murdered Meredith. 2 weeks later when Patrick airtight alibi checked out Patrick was released Knox then said that Raffaele murdered Meredith and was trying to frame her. She has since changed he story at least twice. You people need to accept that your daughter is a rapist & murder.

Because Knox lived in the apartment with Meredith Kercher it's not surprising her DNA is all over the place and on the bra clasp. It is standard practice for police to interrogate suspects until they are so tired they don't know what they are saying, try to scare people into a confession and twisting / misquoting statements. I hope she is not convicted with this questionable evidence. I've seen a lot of documentaries where it was proved people were wrongly convicted.
I don't think she is guilty. It seems the police and prosecutor are going to extreme measures to get a conviction. If you want me to be a law grad - then I will be, just for you ;) - I There is no automatic appeal in the UK - whereas in Italy there appears to be an appeal available to anyone. In the UK you must have a legal reason - not factual - to be able to get an appeal and it really rarely happens in one year. Giselle as a non practicing law grad is a bad Virgil. S/he believes that de novo review occurs only in the event of introducing new facts (wrong), that a right to apeal does not exist in the UK, and that Italy mandates a retrial. It is obvious to any native speaker on these boards that I am a practicing lawyer, yet poor Giselle must assert otherwise (just as s/he fails to fully acknowledge curtknox is a fraud). Taking each point he asserts one by one, anyone will see why reasonable doubt exists.

Amanda claims that she was with her boyfriend, Raffaele, the night of the murder. He maintains that she left his house at 9pm and returned at 1 am. Thus even her co defendant does not give her an alibi.
Where was Amanda when Meredith was murdered. This is the first question any suspect is asked and one that Amanda has yet to answer. NB she did confess that she was at home when Meredith was murdered and heard the screams, but she withdrew her confession and claimed she was physically assaulted.

This contamination that you like to speak of is a matter that must be raised by the defence. The burden of proof is then on the defence to prove that in fact such contamination has taken place. This is the case in most legal systems that I am aware of, it would be ridiculous to propose that the prosecution would have to prove that scientists have done their job correctly - as they are assumed to have done so. This is the same concept as guilty until proven innocent. No contamination was proven.

1) We are not talking about the procedural burdens of evidence but rather those aspects of the case that give one pause, and that make your often rabid assertions about Amanda's "obvious guilt" look shrill, mean spirited, and suspect. 2) It is precisely the various, obvious errors in what was done, what wasn't done, and how the evidence was interpreted (perhaps badly) that legal scholars agree will form the strongest case for overturning on appeal. I was not aware that there was a retrial of the facts in the States.... seems rather absurd because the right to appeal must be based on legal issues and not a dispute of the facts. The facts are for the jury to decide and therefore cannot concern a court of appeal.
In any case I do not concern myself with questioning the system - Italy has its own sovereign state and whether you like it or not Amanda has had a fair trial in accordance with the laws of the country.

I did not say there is an automatic appeal, There is no "automatic" appeal in Italy, for that matter. I said there is an automatic RIGHT to an appeal. As in Italy, the apeal notice needs to be filed. As for de novo review (you are so plodding in your answers it suggests you are either only newly admitted or have very little litigation or transactional experience), both the UK and the U.S. allows for such not only if new evidence is introduced, but if there were any kinds of procedural error.

As far as I was aware there were only two pieces of DNA belonging to RS found at AK and Meredith's apartment - one on a cigarette butt and the other on the bra clasp. Thus there was no reason to prepose contamination. In any case contamination is a matter that is to be proven by the defence in courts.
Also it was testified that the amount of DNA found on the bra clasp was significant and could only get there by RS actually having touched the bra.

In any case there is an automatic right to appeal in Italy, so there is no need to discuss grounds for an appeal. The second trial is almost a retrial and all the evidence will be reconsidered. I believe this is a better system than the UK and US for the defendants

As for your lecturing about legal systems, capital crimes in the U.S. afford the same right of review (an automatic appeal) as in Italy, which allows for a review of both the legal and substantive merits of the trial. Moreover, the whole point of a jury trial is to allow the accused to be judged by a jury of one's peers, and by as unbiased a jury as possible (requiring, de minimis, sequestration and little judge interference). There are sound reasons for sequestration and only non-judge juries.

For anyone interested - the Micheli report is there to read and the judgement on the Knox-Sollecito case will be available in about a month. All the evidence is clearly laid out in a government document and the issues raised by the defence have been rebutted point by point. The forensic evidence, the timeline, the witness statements and the phone records and internet records. There is no reference to foxy knoxy or anything else FOA want to blame the verdict on - pure factual analysis.

If anyone is interested in the facts that have been censored by the American media the judges report from Guede's case can clarify a lot of points. This is an official government document and not some media frenzied statement about foxy knoxy - the facts are laid out and the judge has decided to indict them based on those facts. If there is anyone that doubts the findings that is because the trial coverage has been incredibly one sided.
If you want the truth look up the Micheli report - there are english translations available on True Justice for Meredith Kercher site and the Italian report is available in a government website. There all the gruesome details and forensics evidence (160 pieces) has been revealed. Including the reasonings against the fairy tale reasoning of the defence.

The trial coverage was anything but "incredibly one sided" in Italy, where I live and observed the reporting on the proceedings. I and other Italian friends of mine, including lawyers and trial attorneys, do not see this in the hysterical black and white terms that you propose. I would say about one out of five of the Italian lawyers with whom I converse -- who have no horse in the race but have followed the matter -- think Amanda is completely innocent. You sound like a complete novice.

I have read the Micheli report and the defense attorney summations in the Italian, thank you very much. They are powerful, but not definitive. You are a bad Virgil, a mysogynist, and oddly invested in a matter that has nothing to do with you. Knox stated that she spent the night at Raffaeles apart. when he refused to corroborate her story she then said that she was in the kitchen when Patrick murdered Meredith. 2 weeks later when Patrick airtight alibi checked out Patrick was released Knox then said that Raffaele murdered Meredith and was trying to frame her. She has since changed he story at least twice. You people need to accept that your daughter is a rapist & murder.

You are smart enough to KNOW that DNA evidence will incriminate you, and therefore you take steps to cancel MOST ALL TRACES of yourself, except for the ONE person who is CLEARLY at the Scene of the crime (Rudy), but then you FINGER Patrick KNOWING that the DNA evidence will exonerate him? I don't know whether Knox was guilty or not, but it is obvious that she didn't get a fair trial. In Italy, you are guilty until proven innocent, unlike in the USA. Any Italian will tell you that their entire government, and judicial system, is hopelessly corrupt. Is there any outside factors that are involved; blackmailing, coersion, coverups (something seems deeper) Then you must look at the itialian judicial system how circumstantial is the evidence (or ar they grasping at straws). IS the trial fair, and proper and done in a manner that leaves no question of criminal intent by the prosecutors before all evidence is presented.
Lots of questions I for one say that shes guilty, she has no logical alibie and she had DNA on Merideth.

I think that first of all the metholodgy for going for evidence, and closing off the crime scene (there was apparently tampering after the fact) was asinine.
I think at this point in time everyone is guilty who is around that crime scene. The extent they are and the legal ramifications the can be convicted for, may all be different, BUT a dead body does not exist without some knowledge or reasoning

Because Knox lived in the apartment with Meredith Kercher it's not surprising her DNA is all over the place and on the bra clasp. It is standard practice for police to interrogate suspects until they are so tired they don't know what they are saying, try to scare people into a confession and twisting / misquoting statements. I hope she is not convicted with this questionable evidence. I've seen a lot of documentaries where it was proved people were wrongly convicted.

I don't think she is guilty. It seems the police and prosecutor are going to extreme measures to get a conviction. Perhaps the authorities think they will get a feather in their cap by convicting someone with flimsy and likely fabricated evidence. Even the motive is a fabricated assumption. Amanda's DNA is naturally all over the place where she lived and anything in contact with with with her DNA in the apartment would become contaminated with her DNA.

Your daughter changed her deposition, accused someone innocent (who's suing her for defamation!), has footprints, cell texts and many other proofs against what she says.The Italian justice system is not different from the US dear father. Saying "It's not the US, so everything must be primitive, wrong, not up to standard" makes you sound stupid. I'm an Italian and US citizen, I follow the case and what it is based on is EVIDENCE, not what the media says.I hope Amanda is convicted if found guilty.

Amanda Knox is a pathologic liar and a mad disturbed person , she looks to be guilty beyond any doubt 'cos of tens of coincident evidences .
The investigators made a wonderful job and all the ones who follow this horrible case since the beginning know it so well.
Despite the lobby of some one way nationalistic US media, true facts & evidences count, hypocrite shameless biasing TV specials don't.

Looking at the unbelievable pretension of impunity for their murdering fellow coming out from a relevant part of the US ( with no reason at all since she's clearly guilty ), looking at their bizarre sense of justice, I think I have a more added reason to not go& travel in those lands.
We all know so well how mistaken can be the investigations and what kind of shows are the trials down there in America ( US , Mexico and related countries ),

It has nothing to do with looks. This is a rape murder case to me. Facts: Rudy's handprint in Kerchers blood, his bloody handprint on a pillow case, his bloody prints on her purse and on her cell phone. Attempts to call her bank from her cell phone. He fled the freaking country hiding and didn't call auhorities. Meredith Kerchers killer has already been sentenced to 30 years. I don't want to hear about knox false statement. Google innocent project or douglas preston.
