My OPINION is that two cells are a potential human, that is further in development than the cells are when separate. But that the threshold for deserving protection under the law DEFINITELY comes at viability (not at birth). But I realize there are grey areas before that. After only a few weeks, the fetus can respond to stimuli, has heartbeat, brain activity, and things we define as life -- but to me, a mother should still have rights to do things I find distasteful, up to viability.
"The distinction sometimes made in certain official documents between a human being and a human person to then apply the right to life and physical integrity only to people who are already born is an artificial distinction without scientific or philosophical foundation. "Every human being, from his conception to his natural death, has the inviolable right to life and deserves all respect due to the human person," John Paul II
Abortion was not illegal during the founding or writing of the 14th amendment i believe.

@Dethreid The founding of the 14th Amendment was back in 1868, 105 years before the awful legalization of abortion in 1973.
