However, the power to declare war falls to the Congress. More importantly, Levin points out that the Congress as the all-important "power of the purse." This power trumps any power the executive branch has. If Congress doesn't authorize monies from the Treasury, the president can't send troops.

The question of war (Congress owns), vs military action (President owns), is often unclear. It's a matter of scale, perception, and definitions. I agree that presidents have abused it since WW2, but the two branches have often compromised using congressional approval (I'd assume the USSC would accept those given the Constitution's conflict & ambiguity on the point). For Libya, Obama has no congressional approval, but also has no troops on the group, so Libya favors a military action perspective.
Article1, Section8 - Congress has the power to regulate interstate commerce and to provide for the general welfare of the United States, and can make any laws necessary and proper for carrying out those powers. When the economy fails to adequately distribute existing resources that are necessary for the *survival* of the citizens (health care), then, both as a matter of commerce and for the welfare of the United States, Congress clearly has the power to make laws to address the problem.

I seriously doubt that Levin is endorsing Obama's Libyan intervention. He is just defending the idea that it is not an impeachable offenses because there has been a precedent set over the course of many presidents to use the military without Congress' approval. I am against these interventions, but to turn around at this point and impeach a president for doing what many have done in the past would be ridiculous. A bill would have to be passed to clearly define the president's limitations first.

I used to listen to Levin a lot until I heard him belittle and mock a caller who had a legitimate question about his support for unconstitutional wars. He shouted him down and dropped his call without answering his question.
