    Interestingly I don't think the guy has committed any crime by entering the house and passing out. Aggravated trespass requires intent to disrupt 'lawful activities', and while he WAS disruptive there is no reason here to think he intended to be. Burglary requires intent to either steal, commit criminal damage, commit GBH or rape. Clearly no such intent was present here. Maybe I've missed something but I think his entry and nap were non-criminal. :)

And what's 'pussy' about helping out a young man who was in clear need of being helped, rather than kick his ass for something he didn't even mean to do? Whether you believe it or not, police exist to do exactly this: help a citizen out when he is in trouble, i.e. when he finds an unknown man in his house, and has the courtesy not to do him harm. I show my respect to both the video poster and the North Yorkshire Police; they were both great.

The decision on whether to prosecute is made (normally) by the Crown Prosecution Service, and while the victim's wishes, if known, may be a factor in their decision, victims don't take any direct part in the legal process pre-trial. The CPS can choose not to prosecute even when the victim wants a prosecution. (They can also prosecute with an unwilling victim, and even summons to court a victim who doesn't want to testify.)

As far as I am concerned, as someone who works with the police at times, it was a perfect reason to call them and I wouldn't recommend dealing with an intruder alone, whether drunk, otherwise intoxicated or not.     If Mr. Brewer was to press charges, the guy probably could get arrested for a number of things, but since there was no criminal intent, there's no need to send a guy to prison for a mistake like this.

    Keep in mind that the vast majority of people don't intent to harm others!!

  • We are satisfied there was no criminal intention on the part of the man who had entered the property by accident. He was clearly suffering from the effects of alcohol and was subsequently returned safely to the hotel where he was staying.

    It is pleasing to see our officers’ actions praised by members of the public. Our officers’ conduct shows both their caring and professional attitude when faced with just one of the many varied and unusual situations which we deal with on a daily basis.
