Im not familiar with your case but the Ricci case was clear cut, the city didnt like the results of the exam. If more blacks had won promotion, case wouldnt have gone ahead, everyone studied the same material, there was no "secret" documents given to the new haven 20. Its simple, people do a test, whoever comes out on top gets the promotion, job, etc. Thats how you have a colorblind society.
