You can ask people to leave your property if you do not want them there. Though a lot of people don't agree with this, and it may not be right, it's actually protecting the landowner. That's why I believe capitalism works...if you piss enough people off by asking them to leave, for example, they will go to your competitor and you will lose money.

I think there is more to this story than is being reported, if it is true that he was arrested for wearing that shirt than a great injustice has been made. But more likely then not, he was probably asked to leave and refused and thats what got him arrested. These assholes on the show always bend things to favor their own biased views. For the record I am not for or against the war, I support the 1st amendant, I just believe that the whole story should be told without cutting anything out.
Legally, they're not supposed to do that due to the Civil Rights Act and I believe the Americans with Disabilities Act. But when discrimination does occur, 'victims' tend to have an up hill battle to fight it, and if they win, the mall would most likely be slapped with a minor fine and no one would hear about it. The mall is private land. As the owner, you can ban whatever you like when the people are on your land.
There is confusion because people think of the mall as public land. We don't have the village squares anymore, which would be public land and he could wear the shirt there. It's that malls have taken the place of the village square but it's privately owned.

That means that if I (as an individual) can't tell you who you can have on your property then, I can't appoint someone (vote them in) as my representative and have them tell you who you can or can't have, because they don't have any more authority over you and your property then I do.

I think there is more to this story than is being reported, if it is true that he was arrested for wearing that shirt than a great injustice has been made. But more likely then not, he was probably asked to leave and refused and thats what got him arrested. These assholes on the show always bend things to favor their own biased views. For the record I am not for or against the war, I support the 1st amendant, I just believe that the whole story should be told without cutting anything out.

Legally, they're not supposed to do that due to the Civil Rights Act and I believe the Americans with Disabilities Act. But when discrimination does occur, 'victims' tend to have an up hill battle to fight it, and if they win, the mall would most likely be slapped with a minor fine and no one would hear about it. This antiwar shirt case probably had a much greater affect on the mall's business due to the media backlash, and some people may have decided to at least temporarily shop elsewhere.

The mall is private land. As the owner, you can ban whatever you like when the people are on your land.
There is confusion because people think of the mall as public land. We don't have the village squares anymore, which would be public land and he could wear the shirt there. It's that malls have taken the place of the village square but it's privately owned.
