No, the military could not recruit for employment but this was because Harvard's policy stated there could be no discrimination of people in hiring. I found Kagan to be very intelligent, with an attractive personality, and I ended up liking her when I did not think I would.
That said, her answers about natural rights were awful. The founders asserted that our rights are always there, even without Constitution or Bill of Rights. Life, liberty, pursuit of happiness, assembly, association, speech, religion, self-defense, private property -- all these and more are ours naturally, bestowed by God, not Gov't. She can't think out of the box!

The statement on discrimination of the military in Harvard is only a half truth. No, the military could not recruit for employment but this was because Harvard's policy stated there could be no discrimination of people in hiring. And because of the military's "Don't Ask Don't Tell Policy" Harvard felt the military did not follow their principles. However, the military was allowed in campus by Kagan but not for "employment" purposes.

Harvard is a private campus, and the students didn't want them there! They paid money not to have the military there, bothering them about recruiting while they are trying to study. Saying that the military had a right to be there is an overreach of government. Is your house a private residence? Then lets allow the military to come in and recruit your sons and daughters. Harvard is not a public institution, the government should have no say in what goes on there
