@DarPower1 Federal law also explicitly functions NOT-BY-DEMOCRACY. Judge John Jones gives good exposition on this subject, giving good distinction by the lower courts (many with judges voted in by regional means) who -can- vote for majority rule on some cases.
It's the same mechanism by which slavery was argued judicially on a contingent of merits.
First amendment would also override majority rule for a Federal case like this. The religious connotations of the cross would be easy to submit.
