Money isn't free exercise of religion, we need to make it a felony to spend more than $1 on building churches. Money isn't contraception, we need to make it a felony to spend more than $1 on contraceptives. Money isn't due process, we need to make it a felony to spend more than $1 on death penalty litigation. Money isn't speech, we need to make it a felony to spend more than $1 on books.

  • Think about this: Each citizen in our republic now has one vote. Each person has one voice. Each person is guaranteed freedom of speech. Where in the US Constitution does it say that money = speech?? It does not. This right wing activist court, in an effort to afford their political cronies more power, equates money with speech: someone with more money to have more speech. We need to amend the constitution to make it a felony to contribute more than $1 to a candidate for any office.

  • @haldonrichardson1 Certainly you would agree that a celebrity has more of a voice than an unknown American such as you or I. The words of James Madison and Thomas Jefferson have lived over two centuries while the writings of other, less-prominent, Americans from that time period have not.

  • @stephenabm no. Strong Chief justices get 6-3, 7-2, 8-1, 9-0 decisions. Case in point, Earl Warren was the last strong chief justice. Weak chief justices are often in the dissent or in 5-4 decisions. This has been the trend since late in Burgers tenure, Rehnquist, and now Roberts.

  • @RationaIAthiest The Warren court was the worst court the US had ever had. Justice Roberts correctly makes decisions based on the rule of law - the US Constitution. If all judges conducted themselves in this way, America would be so much better off.

  • @stephenabm How exactly is striking campaign finance laws good? Roberts will never be half the Chief Justice Warren was. Warren was powerful enough to get the other justices to vote with him. Roberts can't get a single liberal to vote on his side. Warren was part of the majority in landmark cases by a fairly decent margin. Roberts was in the 5-4 majority in both Gonzales v. Carhart and Citizens united v. FEC. I've rarely seen Roberts in a 6-3 decision where he gets one liberal.

  • @RationaIAthiest The Campaign Finance Law was unconstitutional, as it violate the "First Amendment" (free speach) and was correctly decided upon. We are a country of laws and not men. The US Constitution is the law of the land. When the liberals start paying attention to the rule of law (US Constitution), they will start voting with the majority of the court. Judicial activism is severely damaging our legal system - personal opinions or political correctness have no place on any US court!

First they're all for the constitution, but they are against flag burning? I thought flag burning was freedom of speech? Funny how you should mention personal opinions. Do you think the conservative bloc of the court bases their decisions solely on the constitution? Its delusional to think justices do not use personal opinions.

  • @RationaIAthiest Flag burning is part of free speech, but many people (conservatives and liberals) are bothered by this act. I am a veteran and understand their anger over it. I am opposed to a amendment to ban this act, but many want it. A judge has taken an oath to make decisions based on the rule of law (constitution), so that should answer your question. There should never be personal opinions in these decisions.

  • Roberts was quoted on the News Hour with Jim Lehrer saying that The State of the Union has been reduced to a speech where petty insults are tossed back & forth for political gain. And nobody takes it seriously anymore.

    What the good Judge obviously can't fathom is that it's not the State of the Union that's been reduced to a sham. It's the US Supreme court.

  • I think John Roberts will probably be one of the most well-known justices to ever sit on the bench. Considering how young he is (for a Chief Justice) and considering the longevity of justices, he could very well administer more presidential oaths of office than anyone else in the history of the Supreme Court.

  • No arguments here. When I predicted that he would administer the most number of oaths, I sure didn't expect this to be the reason. Sheesh! I must admit, I was pissed at Roberts. How could he botch a simple 35-word oath? The presidential oath of office is actually less than half as many words as the VICE-presidential oath, and Justice Stevens didn't seem to have any trouble swearing in Joe Biden.

    Obama handled it pretty well though I must say.

    Read Art. III of the Constitution.

  • He is the youngest member of the Court and yet he's Chief Justice. Bush appointed him so that he could not be impeached, because the Chief Justice serves as judge during the Senate impeachment proceedings. America = Dead.

  • It would have required an Amendment to create the Supreme Court, but Madison and Ellsworth did it with the First Judiciary Act (1789). Congress is not authorized to create a Supreme Court. There is no valid court operating within the framework of the Constitution.
