Look, bars and restaurants might be privately owned, but they are legally considered public areas and are thus subject to public health codes. If the owner doesn't like it, then he should simply make his establishment a private club, and then he can allow smoking there if he wishes.

I worked for Greenpeace for 6 years. I was surprised by how many of the activists smoke. Furthermore, the non-smokers there don't complain about the smokers. They've never gone after that issue. It's the fossil fuels, in their well-researched view, that are dangerous. A large percentage of the Greenpeacers, including me, don't own cars. They ride bikes instead. That is an issue they do repeatedly push.

By the way, to clarify, an apartment or condominium is not "your own home". You rent it. When you rent a movie at blockbuster, you do not own that movie. It is not "your own movie". Research into SHS has never produced sufficient evidence to prove that it causes any harm, and they sure have tried!!! There have been over 70 studies that I know of relating to spousal exposure alone - 5 in every 6 have shown no effect or a beneficial effect. Even the 'official' figure of around 25% INCREASED risk (note NOT actual risk) is tiny and was only obtained by cherry picking the 'right' studies!!

As a free citizen, I find it even more ridiculous that if I wanted to run a smoking restaraunt/bar, etc. that ANY government agency can tell me that doing so would be illegal. What right do they have to dictate what I do on my property? If I wanted to store hazardous waste in my public venue, I'd just have to put hazmat signs, but smoking's just out - period.

I don't lean one way or the other on this issue I'm just curious. One could argue that people don't smoke as much marijuana compared to cirgarettes, but it is still some harmful stuff. Too many double negatives, hard to follow. I don't buy that argument, tobacco smoke contains radioactive isotopes of polonium, radium and uranium (just to name a few). The employer is exposing the employee to these pollutants 7+hours a work day, paying them close to minimum wage with no medical benefits. I worked for Greenpeace for 6 years. I was surprised by how many of the activists smoke. Furthermore, the non-smokers there don't complain about the smokers. They've never gone after that issue. It's the fossil fuels, in their well-researched view, that are dangerous. A large percentage of the Greenpeacers, including me, don't own cars. They ride bikes instead. That is an issue they do repeatedly push.

By the way, to clarify, an apartment or condominium is not "your own home". You rent it. When you rent a movie at blockbuster, you do not own that movie. It is not "your own movie". Why do smokers feel the need to force their fetish on others? I'm heavily Asthmatic. If you smoke around me as much as you do in the house you live in (rented or owned), it would likely kill me. This is insane but doesnt surprise me,even though the true meaning of the studies and risks are just starting to become public,still the majority would rather remain ignorant simply because they hate smoking.I see the last 15yrs of conditioning the public to hate smoking has been a success,they dont care what the truth is,they dont care that we no longer live in a free country,they dont care that our choices are being taken away one by one..this is really pathitic and so are the supporters.

The fact of the matter is smoking causes cancer whether 2nd hand or 1st hand so y should a non-smoker b forced 2 breath in 2nd hand smoke because some smoker doesn't want to get cold?
Banning smoking all together would save our healthcare system loads of money. Why should I pay for ur deadly habit? Evry smoker is affected, unlike cars @ pencils where people can go a lifetime without having an accident or getting poked in the eye.

Research into SHS has never produced sufficient evidence to prove that it causes any harm, and they sure have tried!!! There have been over 70 studies that I know of relating to spousal exposure alone - 5 in every 6 have shown no effect or a beneficial effect. Even the 'official' figure of around 25% INCREASED risk (note NOT actual risk) is tiny and was only obtained by cherry picking the 'right' studies!!

Ju- The correlation with Nazi's is far more persuasive than the one that correlates smoking to all sorts of cancers. Explain why smoking has reduced over 50% over 50yrs or so YET - in E&W
1991 - Cancer cases = 230,000
2006 - More than 300,000
Why have we NOT seen a reduction but a massive increase?
Simple answer - something OTHER THAN smoking kills.

How long do you want?
Take China (not an isolated example) where we know 60% of males smoked -almost unchanged for over 30 years and China has less than HALF of the lung cancers here. See- China was basically a rural economy - now increasingly becoming an industrial one - So cancer rates will increase with the increase in all sorts of pollution.- nothing to do with smoking!
Bottom line - SHS is harmless - why should we have to put up with your religion being stuffed down our necks!

My 2 points are simple: 1) The best way to violate individual rights or property rights is by using the pretext of "health concerns" or "think of the children"

You cannot even prove it is likely someone died of second hand smoke. It is just as probable that they died of pollution from cars or from a poor died. Just because you have a bloody nose and have been exposed to smoke doesn't mean there is a correlation.

As a smoker, I find these bans absolutely absurd. As a free citizen, I find it even more ridiculous that if I wanted to run a smoking restaraunt/bar, etc. that ANY government agency can tell me that doing so would be illegal. What right do they have to dictate what I do on my property? If I wanted to store hazardous waste in my public venue, I'd just have to put hazmat signs, but smoking's just out - period.

Cool, I respect that. I have a serious question to ask you. As someone who condemns the smoking of tobacco, would the legalization of marijuana raise any concerns? I don't lean one way or the other on this issue I'm just curious. One could argue that people don't smoke as much marijuana compared to cirgarettes, but it is still some harmful stuff. Recent studies found a marijuana-testicular cancer link.

The discretion should left to the bar/club owners and patrons. Non-smokers often make the argument that they are being "forced" to inhale second hand smoke. They are not. Nobody forced them to get dressed up, drive down town, enter a PRIVATE establishment, and inhale the smoke. This is where personal discretion comes in. Just as it is not McDonald's fault that you're overweight, it is not the bar's fault you're inhaling second-hand smoke. It happens as a result of your voluntary action.

hahaha wow what a crazy woman "it´s our responsibility to take care of everybody" yeah right, someone should just kidnapp her and blow smoke in her face, who knows maybe she can get u convicted for attempted murder. I actually agree that u should be able to ban smoking if u like to, as a restaurant owner, as a landlord (it really damages the appartment), and so forth but the gouverment has no business telling people what to do with their own lungs and property.

I'm an ex-smoker & I hate being exposed to cigarette smoke, but what someone does in the privacy of their home is NO PLACE for the government to butt in (pun intended).
This reminds me of the news story about the painter in England who was arrested for smoking in his truck because that was his primary "workplace" & it's illegal to smoke in the workplace!
I hated my parents smoking in the car, but today they would be fined in California. Stupid "caretaking" laws! Educate instead.

I agree with letting bar owners and other adult establishments deciding their smoking policy. (most would keep the ban unless they are a "dive bar".) But I have to deviate from the libertarians on letting resturants decide their smoking policy. People should be able to sit down and have a meal with their family and not have to smell of tobacco smoke. What about those people's rights. Tobacco smoke does infringe the rights of non-smokers even if the risk of lung cancer is low. (continued)

What about asthmatics? Now they cannot go out to dinner anymore. What about people who want a bite to eat and do not want to come home with a nicotien induced migrain and clothes saturated with tobacco smoke? Also there are studies that do show that working in an establishment that allows smoking can be worse for your health than living with a smoker. Tobacco use is a known environmental pollutant and should be treated as such.

yes? many establishments will accomodate this groups needs without the state meddling in and telling everybody whats good for them. I agree that if you have children maybe it´s ok to lagislate that u cannot smoke in their livingenviroments because after 20 yeras that will take it´s toll, but legislating that u cannot expose other adults and their property to smoke even with their consent is retarded.

Too many double negatives, hard to follow. I don't buy that argument, tobacco smoke contains radioactive isotopes of polonium, radium and uranium (just to name a few). The employer is exposing the employee to these pollutants 7+hours a work day, paying them close to minimum wage with no medical benefits. Something has to give, either ban smoking in restaurants, (I'm not opposed to allowing smoking in Bars and adult establishments)or have the employer provide med. benefits.

Fucking fascists! sorry I lost my temper, but they mess with property rights. Here's my prediction: since racism is a form of mental illness (there has to be some doctor out there willing to say that), and since the president is black, then all criticism will be viewed as racist, so any opposition should face the department of health. That's why nazis used health departments and health policies, that way you can always claim it's for the greater good, for the children!!!!

lets ban fat people they are unhealthy. ban motor vehicle's they put out harmful emissions. ban all meats they have harmful steroids and antibiotics. ban birth it leads to certain death. ban war its pretty harmful also. ban spiders and snakes. ban dogs they bite people. ban corn oil. ban butter. ban guns. ban knives. ban sharks. most of all ban religion it has caused more deaths than anything that has ever come down the pipe. fuck it ban humans that would solve all the problems this planet has.

I'll take the risk of lung cancer over having these government pigs with their faux indignation and/or their smug pedosmiles tell anybody what they should do in their own business or in their own homes like this. If I don't want to be around cigarette smoke so that I remove the minuscule 1 in a trillion chance of getting lung cancer, I'll just not visit people who smoke or go to establishments with smoking. I don't need a goddamn law forcing other to live the way they think we should.
