Interception of communication is only valid when in a private situation and there is no consent from all parties. Otherwise it's protected by the 1st amendment which trumps any state law or city ordinance. In public, NOBODY has a reasonable expectation of privacy. This applies not only to images, but words as well.

The best way to deal with the legality of video/audio recording of on duty law enforcement is get a copy of THAT law, read it, know it, and have a small size copy with you. Laws are different per state. Some cops use the "audio recording violates the wire tapping laws" routine to scare you. BULLSHOY!! Wire tapping has to do with secretly "tapping in" to private telephone conversations. Just DON'T have anyone on a phone while recording. Technically that could be illegal.

There was a case in Maryland similar to this based on a wiretap statute. It was thrown out and it was ruled that you have no expectation of privacy in a public place. Thats a real no brainer.

If they have nothing to hide it shouldn't be a problem, I had a run in with police today (sep.21 2010) and it was beaverton police and they would not allow me to record. The officer said something to me that I took as a threat and if it was recorded I might have been able to go after him and correct him through his supervisor. I was told that the officer could contact the county and revoke my gun license for simply open carrying and YES I CAN OPEN CARRY IF I WANTED TO BY LAW.
I can understand such a law if the "communications" that are being "intercepted" are being CONVEYED via some electronic device (like a telephone), since the fact of the recording can be wholly kept from at least one of the communicating parties; but a law which makes illegal the audio accompaniment of a video being shot openly in public seems just plain idiotic.
We need laws that make it illegal for homeland security or law enforcement to conduct an arrest, raid or an insurrection againt an American citizen or citizens without the camera and sound rolling. In legal terms this is called a prior restrain to freedom of the press. Interception of communication is only valid when in a private situation and there is no consent from all parties. Otherwise it's protected by the 1st amendment which trumps any state law or city ordinance. In public, NOBODY has a reasonable expectation of privacy. This applies not only to images, but words as well.
He may lose on a state level, but with appeal, a federal judge would void his arrest; opening the door for litigation for multiple civil rights violations.

If you are video taping someone, and talking on a phone with someone at the same time, you could be in violation. This is a civil action not a criminal action. Get a lawyer and be prepared to apeal to a higher court if the charge(s) are not dismissed. This battle is being fought everywhere. More and more citizens are winning their case.

The best way to deal with the legality of video/audio recording of on duty law enforcement is get a copy of THAT law, read it, know it, and have a small size copy with you. Laws are different per state. Some cops use the "audio recording violates the wire tapping laws" routine to scare you. BULLSHOY!! Wire tapping has to do with secretly "tapping in" to private telephone conversations. Just DON'T have anyone on a phone while recording. Technically that could be illegal.

There was a case in Maryland similar to this based on a wiretap statute. It was thrown out and it was ruled that you have no expectation of privacy in a public place. Thats a real no brainer.

If they have nothing to hide it shouldn't be a problem, I had a run in with police today (sep.21 2010) and it was beaverton police and they would not allow me to record. The officer said something to me that I took as a threat and if it was recorded I might have been able to go after him and correct him through his supervisor. I was told that the officer could contact the county and revoke my gun license for simply open carrying and YES I CAN OPEN CARRY IF I WANTED TO BY LAW.

I can understand such a law if the "communications" that are being "intercepted" are being CONVEYED via some electronic device (like a telephone), since the fact of the recording can be wholly kept from at least one of the communicating parties; but a law which makes illegal the audio accompaniment of a video being shot openly in public seems just plain idiotic.

What police do is arrest people for recording them and then drop the charge before it gets to court, knowing the law will be declared unconstitutional. In legal terms this is called a prior restrain to freedom of the press. I personally know a girl who spent a week in jail and was seriously abused for this but for some reason the ACLU has been asleep on this issue because these laws have been on the books since the seventies.
