1. Are the questions on them standard firefighter questions for fire chiefs.

2. Have other black firefighters taken a similar test and passed it?

I'll wager this issue made it all the way to the Supreme Court and no one ever even bothered to examine the test questions.

There is no such thing as a perfectly designed test. The test was designed to be difficult, to highlight the best employees for promotion. It so happens, that the white men scored better. It's not flawed. They worked harder. Plain and simple.

You make an interesting point, but unfortunately the Republicans have a record of racial politics just like the Democrats. When they rearranged Sotomayor's words around to make it sound like it was pro-white they were appealing to their Republican voters which is about 90-95 percent white. Dems do the same thing in casting that Repubs are racist, exclusive to black people and other minorities. The racist label doesn't fit with Boykin. Just because some suggests race doesn't mean they are racist.
