@dreikant123 bro, i'm thinking u are joking since bmw's size wouldnt care about the power boat :-) but in case u are seriously asking, rules are different between power boats and sailboats. it was inconsiderate for the power boat to cut across the sailboat, the other way around is permissible because they are looking for propulsion from the wind, as opposed to power boats that are self-propelled and can turn better on a dime. sailboats generally have right-of way like pedestrians vs. cars.

Always go TO the direction of the wind correlated to the boat and not AWAY from the wind (correlated to the boat), because you didn't leave enough place to manoeuvre for him.

@dreikant123 Ship captains are actually legally required to do everything possible to avoid a collision, so yes, he would have had to make an evasive maneuver. The motorboat driver was a douchebag because he kept putting his boat in the line of the BMW, which is hugely annoying because the captain of the BMW has to take the possibility into account that the engine of the motorboat dies unexpectedly or has some other kind of emergency that suddenly limits the maneuverability of the motorboat.
