Unfortunately, Rare isn't in the position to do so. Microsoft now owns the rights to Conker. That's precisely why it wasn't and won't be released on the Wii's Virtual Console.

Nintendo is powerless to do anything about it. It's a shame, because that game is in extremely high demand.
