  • @superlativeOFgood I have far more respect for kings and monarchy then I do have for republics. In my oppion Kings are far more braver then elected presidents. In history you see many kings like William I, Harold I,Richard I, Edward I, Richard III and Henry VII who personally fought on the battle field with their troops and in the cases of Harold I, Richard I and Richard III died on the battle field. They did not flee from danger like presidents like James Madison. Presidents like to say safe.

  • Judge Andrew Napolitano should realise how disgusting and hypocrital the Constitution is. The Consitution never allowed women to vote until 1920. If the Constituion meant what is says, then the United States should have had women governors, mayors, senators, representives, secetaries and presidents and vice presidents as early as it's independece, but it did not. The Constituion belongs in the trash bin. Slave owners such as Washington and Jefferson have no right to speak about freedom/liberty.

  • @superlativeOFgood The Constitution did not protect blacks, Indians and women from being treated as 2nd class citizens. The Constitution only gave freedom and liberty to landed white men. This fact alone is why the United States Constitution must be dumped int the trash bin of history and a new one written by people who are not plantation slave owners such as George Washington and Thomas Jefferson. A plantation slave owner talking about libery is like a Nazi talking about Jewish rights.

Who do you believe would be qualified to write it today, and if you have a good answer, what if others prefer a choice you don't care for. For better or worse this is the document we have. As for the "property of men" I blame the bible and the history of western civilization for their contemporary views.

I love how Constitutionalists complain that the United States is run by the corporations and big buisness, well it has always been like this. Many of the people who wrote the Constitution were what we can call speciali interest groups such as George Washington who was a planter and Alexander Hamilton who was a banker. Alexander Hamilton would be a big fan of the Federal Reserve.

  • @superlativeOFgood The founding fathers of the United States who talked and preached about liberty and equality and freedoms themselves did not live up to their ideals. Liberty and freedoms were denied to women, Indians and blacks and I do recall that John Adams (Hero of Constituionalists) himself created the Alien and Seditious Acts which put people in jail for excersing freedom of speech. The founding fathers did not want freedom and liberty fro the lower classes but wanted all the power.

The men who wrote the Constitution only applied liberty and rights to white men, women were treated little more then property of the men. Now I would have had more respect for the Constituion if it meant what is says and women should have been allowed to run for president and other offices as soon as it was signed.

  • @superlativeOFgood The United States Constitution allowed the institution of slavery to flourish and did nothing to abolish it until the 1860's and that only happend because of the American civil war. The politicans in the south and the vas majority of the people not only did not support the abolishment of slavery but fought to keep it alive at the cost of about a milliond dead. Which was it, the Constitution or the Bill of Rights which declared a black person 3/5 of worth to a white person.

However, I sadly note my opinion that the Judge here appears to greatly sell himself short by appearing unduly flattered at the mere thought of his being nominated to the Supreme Court by Ron Paul, were the latter elected President. Rather, I think the judge should think about what he might say or write under the much more ambitious scenario wherein the rewriting of the Constitution of the United State of America is the task set before him!

I say none, I believe it has to do with the fact that if someone commits a wrong according to one state's laws, and they escape to another state whose laws do not bar him from his past action, he must be transported back to the previous state for due process.

  • Stop the bribes to the judges of California. Los Angeles County judges are receiving $57,688.00 per year per judge. That is on top of the pay and benefits they already receive from the STATE.

  • This should be required study by all high school students. Judge Napolitano has a perfect understanding of our Constitution and Bill of Rights. The U.S. Supreme Court needs to hear this as well as all of Congress.

  • @TheRoadrocket Actually, it is arguable that the Constitution is anti-libertarian - after all, it was written by East Coast elites, passed illegally, supported by the Mercantalist-Centralist Federalists and sponsored by banksters. The Judge has a libertarian interpretation of the Constitution, but that doesn't make it the correct one.

    Just thought I'd clarify; no, it is not a free society, as the government does not truly fear the people. You see, they get re-elected not through protecting the freedom of the people, but by creating a public trough from which they give handouts (I don't mean welfare checks here). This satiates public greed and gets them re-elected, not even considering that many people are simply apathetic and will not vote for someone based on the issues.

  • Napolitano's opinion is the same as ayn rands argument against collectivism and reflects the key understanding that a gov whose charter is for the "public good" or "the most good for the most people" is on a course for fascism and totalitarianism, for this same gov will define what this "good" is. the focus must always be on what is best for the individual. what is best for the individual is best for the people. what is best for the "group" is best for the gov...and the enemy of the people.

  • human beings have many fears and desires, we have alrtuism (the desire to sacrifice ourselves or our neighbours for the greater good), mutualism (eye for an eye, tooth for a tooth, one hand washes the other), and egoism (sacrificing the greater good for me). saying the laws of trees exist before trees came into existence is absurd, so is saying our codes of conduct exist before we concieve of them. government claims it desires the greater good more than you do, but how do you know?

  • our rights don't come from god, they come from our natural fear of death, our desire to be free, our courage to stand up for ourselves and others and our ability to articulate these fears and desires. at least that's what i think. they don't exist prior to people, but at the moment they concieve of and declare them. but within us also exists the desire to protect the greater good, which sometimes comes into conflict with our other desires, so we try to satisfy both desires as best we can.

  • Napolitano is the only person that I think is smarter than Ron Paul in the freedom movement. I love Paul but even the Judge knows Austrian economics as well as he knows the law when he talks about it. It takes a life time of studying to become as smart and informed as the Judge.
