Saying that too many white people passed a test and that the test must be re administered means that they are basing a judgement on skin color. This means racism. Any judgement where skin color is the issue means its a racist issue black or white. Saying "too many white people passed" and then forcing the people that passed to take it over, is racist pure and simple. If a "racist" is anyone who thought the city of New Haven had grounds to invalidate the firefighter exams due to an adverse impact, that means that the District Court that ruled for the city is racist, that the 2nd circuit court of appeals (when Sotomayor was on it) is racist, and the four Sup.Court justices who ruled for the city are also racist. So I take it you're saying anyone who is inclined to rule for aff. action is a racist?

At the same time, that doesn't mean that I think that anyone who is in favor of affirmative action is a racist. Nor should anyone call any of the (mostly) white federal judges (in the District Court, the Appellate Court, and the Supreme Court) who ruled for New Haven racists simply because of they took a legal position I disagreed with.
