It amazes me see how little reguard our City Council, and of course 'Good 'Ol Boy" Bonnie Dumanis has for the well being of the people that elected them. Do they honestly think they will be re-elected??Get behind it..throw them all out of office!!!

Now Eugene is going to trial! The trial date will be set on July 27th. San Diegans should remember how much was spent on prosecuting medical marijuana when they wonder why things like fire prevention and libraries are underfunded.

Here in San Diego we live under one of the most corrupt city governments imaginable. Its like a mini Soviet Union. They dont even allow free speech when addressing the city council! I would suggest you read 113.765 and 113.775 of the California Health and Safety Codes which provides exemptions from sales and ALL related sales prosecution when SELLING to a legal medical marijuana patient OR their caregiver. To SuperWill2000- The federal part most certainly was entrapment because this was a normal looking house in Pacific beach that showed no indication whatsoever of being federally owned. So they most certainly entrapped them. Further the only law that was broken was by the police when they fraudulantly obtained a medical marijuana recommendation. More lies - cops used fake id's. More lies - da says "dangerous drug felons at military sites ACROSS San diego, more lies more wasted taxpayer money!

113.765 AND 113.775 as well as the legislative notes provide exemption for sale, but not for profit. So the service he was providing was legal and should be apreciated. If anybody was violating a federal law, than it was total entrapment because their was absolutely no indication that the house was owned by the navy and they tricked people into going there. What is it then?

Government agents entrapped someone if three things occurred:

1 the idea for committing the crime came from the government agents and not from the accused.

2 the government agents then persuaded or talked the person into committing the crime.

3 The person was not ready and willing to commit the crime before the government agents spoke with him.

Endless Summer was targeted at drug dealing in military housing. WRONG. Records of calls show NO complaints. Nothing in the law allows the police to lie to doctors to falsely obtain prescriptions. The cop committed medical fraud and obtained a medical recommendation from a doctor. Would the police go arrest a pharmacist who tries to help them?

Entrapment: the action of luring an individual into committing a crime in order to prosecute the person for it. ((Websters dictionary ).

It's not entrapment since it was a "service" he was already performing. Entrapment really is "Was the police conduct likely to cause a normally law-abiding citizen to commit the crime? (Barraza (1979) 23 Cal.3d 67)" These guys were violating federal laws through a service he was already performing, so no entrapment.

That is the key because collectives are allowed under Prop 215 and SB420. The police are breaking the law by targeting the people in this way.
